Credit Card caharges 6 yr limit??

Hi Everyone,

I have wrote to several credit card companies asking for my old charges back. I have my old statements. These go back to pre-2006.
They all replied stating that they do not have to pay due to the Limitations Act and the 6 year limit. I thought that this applied just to bank charges and not credit card charges. Anyone know for sure what the position is please as I have read conflicting opinions.

The limitations act applies to all cause of action

However, the clock starts ticking at the time you can reasonably be expected to have become aware that HAD a cause of action

Meaning, if you were only made aware of your right to claim such charges by the TV ads etc, you could reasonably claim that date as approx 2010, with your limitation time not being until 2016

Dear Sir/Madam,

I acknowledge receipt of your recent letter, dated INSERT LETTER DATE HERE in which you attempt to claim that the statute of limitations act 1980 prevents my valid claim against you for unlawful charges.

I wish to draw your attention to the paragraph within Schedule I, Paragraph 5 of the act that states:

"An action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued"

My cause of action arose from the date upon which I became awar4e of my right to claim back your unlawful charges to my account, namely INSERT YEAR HERE, meaning that the limitation period would only take effect in INSERT YEAR + 6 HERE.

I have no doubt that you were in fact very much aware of this, and have sought to avoid making lawful recompense by being selective with your quote of the statute.

Therefore, I must respectfully ask that you now investigate my lawful and reasonable complaint and refund the amounts charged so further action against your company may be avoided.
