Thank you for your interest. Yes I am 68 years old and not in the best of health. I had cancer grade 3 and was very ill for some considerable time. I am, as far as I know, show no sign of metastases. I am registered disabled. My mobility is poor and I am quite unstable, having fallen several times. I put my deteriorating health down to the result of heavy doses of chemotherapy and radiotherapy. I am aware that I am increasingly frail. The bailiff has not entered my home, but doubtless he will return very soon. I am fearful as his attitude is bullying and I pick up on his aggression. Anne

Make sure the bailiffs and the council know that you are registered disabled. I don't know the rules but somebody will be along to explain that it will be to your advantage and the bailiffs should be more considerate.

You need to advise both Council & Bailiffs that you are existing on a pension, have health & mobility problems and should therefore be classed as vulnerable according to the National Standards for Enforcement Agents. You will need to provide proof of same but do not let this prevent you writing in the first place as any proof may be provided on a to follow basis. Proof could be just as simple as an award notice of Benefits/Pension or letter from a medical professional. Your account should be recalled from Mr Numpty and dealt with accordingly.

I would also urge you contact your local Councillor(s) ASAP and advise them of the situation and ask they intervene. If you are met by refusal or they are reluctant then go straight to the Leader of the Council and his opposite number. Contact is best made by phone.

Is there any chance that you would have been entitled to Pension Credit (due to your low/no income) and/or Council Tax Exemption for the period to which this *debt* relates?

po9 private pension is only just above any entitlement to pension credit. I was given a 20% reduction to my council tax as a single person. My daughter has been my main carer for 5 years now. I am in receipt of higher rate mobility allowance and the lower rate attendance allowance.

I was so distressed all night that I was terrified to stay in my home. I left before 7.30 am and returned just 10 mins. ago.

Anne please believe me when I say this will get sorted :hug:

Someone on here will tell you how to handle the situation if a bailiff turns up at your front door and whether (or not) they have the right of entry.

If your daughter is your official carer maybe she can deal direct with these bullying bailiffs if you give her the relevant third party authority. I'm almost the same age as you and I pity any bailiff who had to deal with my daughter because she would certainly give them hell :argue:

1. £997.81 on date of setting up 2 x weekly payments of £25. First instalment paid 14 January 2013 Since that payment the total amount paid via their automated payment system and including the first instalment is £175

2. I do not know the Bailiff fees. The amount demanded I pay forthwith is still at £997.81 which also states including Bailiff fees.

It does seem as if the bailiff has chosen to pretend he has a valid levy of distress. If he has not levied upon or "seized" goods outside your home (such as a motor-car) and he has not been allowed in for any reason, then he does not have a valid levy and may not lawfully charge fees as if he does.

If he has levied distress upon any goods, he must leave a Form 7 (Notice of Seizure) with the debtor.

The attached file lists the fees that may lawfully be charged.

From what you have posted, it would seem the bailiff may only charge £42.50 for two visits.

Regardless of what the bailiff might claim, he is not allowed to seize your daughter to sell off as a sex slave. :grin:

Thank you. I have not told my daughter. She moved from my address a lost 3 weeks now into her own flat. She has had such a difficult the over the last few years. Her anxiety over me and her own health issues have taken their toll on her physically and mentally. I do not want her to know, she is a body of nerves as it is and I have serious concerns for her mental health. Thanks Anne

Hi! Today I contacted Horsham Council Recovery Debt, as advised. Rossendales received the enforcement request on 6 Nov 2012 The sum of £952.81 was demanded. I understand that costs incurred by them were £130. On 13 December 2012 I was visited by a lady bailiff who identified and listed the items to be levied against the debt i.e. 2 x bedroom cabinets, carpet, microwave, (I no longer have this item as it no longer worked) and a small freezer. The costs for this visit were £63 and I remember now that I did sign an agreement re the above and set up the arrangement to pay at @% every 2 weeks. Rossendales have taken their fees against payments received. The latest visit to my home accrue the additional costs of £42.50. These costs were not itemised. When I spoke with the Bailiff on his mobile yesterday 07725247394 I felt intimidated and bullied. He was not interested in the fact that I am registered disabled and have poor mobility and health issues. He stated several times that he would return again and suggested he came round directly, to which I answered that i did not want that. He added that he intended to remove items by any means he chose even in my absence. My appeals to him to reconsider setting up an agreement to continue with the payment arrangement at £50 cpm by direct debit. The answer was a firm "No" i said that I believed that this could be done and that it was possible for him to recommend this arrangement to his company. He refused and was adamant that he had a job to do and he would return.

I have today 10 April notified Horshan council, recovery team that I am registered disabled and suffer ill health and poor mobility, and that i have a carer. I live on a small pension. I consider myself vulnerable and the council agreed to notify you. Today I contacted Horsham Council Recovery Debt, as advised. The council advised the following: To contact Rossendales to inform them of the my contact to council recovery team, who noted that I felt vulnerable and also know that I am registered disabled. Here is a copy of that email: Contents as per the above post plus:


"Your bailiff was intimidating and unrelenting. I was , in fact terrified and left my home unattended all day. I consider that I am vulnerable and I need you to be aware of the bailiffs aggressive verbal approach, which I took as bullying. This is the basis of my complaint I am making regarding his tactics. I am now terrified to meet this man and his assistant." This forms the basis of my complaint to Rossendales.
