  • Advice on a DVLA fine if possible

    Hi
Thank you for granting me membership to this site,i shall be sure to make a donation at some point as I am passionate about people knowing their rights.
Anyways back in October I had released that my road tax had ran out I was used to the DVLA not sending me a reminder as they had for the past 3 years,I had send them e-mails ask why but with no response, anyways I rang the DVLA to pay my road tax and also back pay the month I had missed the guy on the phone said it was all ok and that the payment had gone throw and I would receive my tax disc in the post,2 weeks later I received nothing so I rang them they said they would ring me back but nobody did.

Then in januaray the previous owners of my vehicle received a letter In the post asking for a £60 out of court settlement for my vehicle being untaxed,I got on the phone to the DVLA asking them what was going on they said somebody had accidently removed me form their system and that all my post had been going to the wrong address and that they took no payment form me over the phone so I checked with my bank and only a £10 payment had come out.

Later I payed my road tax and called the DVLA they asked me if my road tax had been payed I said yes, they later sent me a letter saying that they had updated my profile,I assumed that was the end of the matter until they decided to send me the £60 fine they had tried to make the previous owners pay,I wrote back makeing an off to pay for the months I had not had my car taxed but they did`nt even read my letter they just returned my check saying the £60 cannot be payed in installments

I am aware that I may have breached the law myself as well so perhaps i have no choice but to pay but before I do I was just wondering if anyone new any parts of the law that could perhaps help me.

    regards james peace

I would be inclined to pursue this with Simon Tse, CEO at DVLA, copying this to the SoS at the Department for Transport. From what you have said, DVLA have been negligent and careless. Don't let them bully you.
Life is a journey on which we all travel, sometimes together, but never alone.

Thanks thats definitely worth a try, also just wonder if anybody knows how long the DVLA have to issue a fine, because I believe they sent me the fine more than 30 days after the so called offence,I m not sure what the law is their if their is any deadline they must follow.
