  • Hi Everyone-has anyone heard of Webb Resolutions Limited?

    Hi everyone
    I've been inspired by some of the issues that people have had and find it amazing that there is actually people who make time to help and advise. As a critical care nurse I help people in other way but finances are my Achilles heel! I would be really grateful if anyone could help me with an issue I have been trying to resolve myself for months. Everything I read though just confuses me more. Basically in April 2007 we took an unregulated secured loan with picture loans, it was for £38000 payable over 300 months with no PPI. At the time we took out the loan our mortgage balance was £152450 and we gave an approx house value (going on sale of neighbours) of in the region of £155000.
    When Picture went under, Webb Resolutions Ltd took over the loan. Currently we pay £344 per month and our latest statement shows our outstanding balance to be just over £36500! I didnt understand why this was still so high and Webb were very unhelpful. To understand it better I wanted to look into it, as I am a bit of a hoarder I still have every piece of paperwork from taking out the original loan,
    which incidentally is unsigned by a picture representative on the reverse, I presume the number they have written next to the signature box is ok.
    I have been reading about the change in the £25k limit on regulated loans and wondered whether there was anything in the unfair relationship part of the regulations?
    This loan is becoming increasingly difficult to maintain on top of our Yorkshire mortgage of £804 a month so I would really appreciate any help.

        The only way I know of Webb is that they are connected somehow with our mortgage lenders Rooftop Mortgages. They seem to also be connected to many other mortage companies as well. You may want to do a S78 request as well - see this article from the BBC http://www.bbc.co.uk/news/business-13349239 it is important that you cover all aspects of your mortgage as there is something fishy here with the amount of mortgage that has doubled and it may be the interest rates, but as we know the last few years the mortgage rates have dropped dramatically.

        The best way to find out what is going on with your mortgage account with Webb is to send them a SAR (Subject Access Request) this costs £10 and then they have 40 + 2 days to respond this should give you everything you need to know with how your mortgage account is being made up and this will also show up what excessive charges have been applied to your account and which could be challenged. If it is anything like Rooftop charges they are outrageous.

        Please find below a speciman SAR which you should adapt to suit your needs. Please add or take away anything which you feel is not relevant to you. Once you have a full response from this comprehensive request then we can evaluate it in more detail. It does seem off that the loan has doubled... and that must be of concern to you and thats why we need to know exactly what is going on here. This SAR shoul;d be addressed to the Data controller.... you may need to find out who that is. If you check with the ICO, they should state who there Data Controller is and address for sending this document.

        You are also reminded that the ICO state that whilst the maximum limit forcompliance is 40 days Data Controllers should not use this as a guide forcompliance and should whenever possible provide the information as soon aspossible.         Non-compliance with our request is a criminal offence under the above Acts andwill result in a report being submitted to the relevant statutory authorities.

        As you are aware, a credit agreement that is not properly documented and signedby the customer is totally unenforceable under the CCA and therefore is acomplete defence to any court claim that is issued.


        Finally, please understand that this alleged debt is now in dispute and allcommunication must be in writing. Since we have made formal requestsunder this legislation you are obliged to provide us with that information andyour employees should not pursue the alleged debt. we would remind youof the law related to harassment and the OFT guidelines.


        Section 40 of the Administration of Justice Act:
        (1) A person commits an offence if, with the object of coercing anotherperson to pay money claimed from the other as a debt due under a contract he-
        (a) harasses the other with demands for payment which,
        in respect oftheir frequency, or the manner or occasion of making any suchdemand,
        (2) A person may be guilty of an offence by virtue of sub-section (1) (a)above if he concerts with others in the taking of such actions as is describedin that paragraph, notwithstanding that his own course of conduct does not byitself amount to harassment.”
        Furthermore your attention is drawn to:
        Both the Office of Fair Trading and trade associations (run by the creditindustry) have produced guidance on what activities may be consideredharassment and should therefore be avoided by creditors. The following list istaken from the new Debt Collection Guidance for holders of consumer creditlicences.
        Creditors are warned by the Office of Fair Trading under the Debt CollectionGuidance that the following practices are "considered unfair":
        “PUTTING PRESSURE ON DEBTORS OR THIRD PARTIES IS CONSIDERED TOBE OPPRESSIVE.”
        This includes:
        • Contacting you too frequently
        You are instructed with immediate effect to destroy all records of any phonenumbers you may have where I can be contacted and to instruct all employees tonot attempt to telephone me whilst this alleged debt is in dispute. Failure tocomply will result in formal complaints to OFT, FOS and ICO requesting removalof your license to conduct any Consumer Credit trade and a complaint to thepolice seeking prosecution for harassment.

          Oh wow! Thank you for that!! I have just got home from work so I'm sorry I have not replied earlier! I will get onto that straight away! I've re read what I put and I'm sorry for not being clearer, the £804 is not with Webb that is our main mortgage with Yorkshire. It's £344 for Webb.
          I did email Webb in March 2011, to ask for a full statement of our loan, as I couldn't understand why after paying £344 roughly for 4 years, we still had an outstanding balance of over £36500 out of the £38000 we borrowed. I have received a full statement which again I do not really understand, huge interest payments and administration charges we knew nothing about. I gave up trying to get any sense out of Webb, all I needed was an explanation but they just dismissed my queries.

                Sorry Dolly, it has been a traumatic week work wise and I don't have a head for much before the weekend -. See if you can use a computer to do this rather than an ipad? Then I can look at it later in the week when the stress is off.

                  Have to confess I know nothing of these things but can I hazard a guess as to the reasons the figure is still so high after you paying for so long. Chances are it was front loaded with interest, commissions or charges.

                        thanks for having a look, I appreciate it as know you are mad busy! I bet you never stop! The advances were to pay off existing debts to leave us with just the picture loan. That is what they said would be best to do, take a big enough loan to pay off all existing debts at the start.
                        What I don't understand is the amount of interest added to the loan each month and why it seems to vary so much, even though we have not been told that the interest rate has changed. I don't get how they work it out. If you don't get chance to have a look,I understand and thank you for your helpful info, if you do that would be great

                          Hiya, an update for anyone who has had a secured loan taken over by Webb Resolutions!!
                          Our loan was originally with Picture, then taken over by Webb. There are so many different branches that make up this group of investors to make it legal. Despite the numerous party involvement there is one thing they seem to miss, the basics of the loan agreements they take over. I paid to have our loan looked at by an independent financial legal type person and the first thing they commented on, which I didn't think was that important, was on the reverse on the loan agreement were there is meant to be a signature to represent Picture, there is just a number, no signature! I am waiting their full review of the loan agreement, I collect it on Tuesday this week, but thought I would let others know that sometimes things can be right under your nose and you don't see it. I wasn't looking to discredit Picture or to get out of the loan in any way, I just found Webb very unhelpful when our remaining balance gave me cause for concern, that's the only reason I started looking into it. Will let you know what I am advised...

                            Hi Dolly77, please take a closer look at the payments you have made, the dates made and make sure they have all been deducted from what you owe and not added to it! Make sure they have recorded every payment at the right time, they sometimes hold a payment back saying they can't find it and then add fees etc on for the payment not being there on time! Devious people!

                              Hiya thanks for post! Will look into that. It's very confusing, we took £38000 secured loan with picture in April 2007, interest initially 9.9% to consolidate existing debts etc, it was over 300 months and in total we have paid back £23,256 in 68 months but Webb say that our current balance outstanding is £36689 or there abouts. We have not missed a payment, the odd time it has been late when I was on maternity leave mainly but always paid within the month. It's as if each payment we pay about £20 off the balance, surely that can't be right?
