    Hi Everyone,

    I really need some advice please about an ongoing issue with my flat. I live in a flat which I obtained under the part-rent part-buy scheme. I own 50% so I pay a mortgage for that, and pay a rent to Affinity Sutton Housing Association (HA)for the other 50%. I have lived in the flat for 4 years since July 2008. There has been a catalogue of issues since that time. The major one is that in 2009 a leak came through my ceiling from the flat above. When the HA did their investigation, it was established that the terrace on the balcony was not sealed properly, so that whenever it rained heavily, the water seeped through to my flat. They did some repairs and apologised for the inconvenience. In 2011, the leak reappeared, and in a much larger area of my ceiling than the original leak. It was reported again, and the HA sent me documents and told me to take the issue to their Insurance Company. I contacted the Insurance Company but I was told and agreed that it made no sense painting my ceiling as the issue that was causing the leak was not dealt with. The HA did nothing to try to resolve the problem, and after I while I got tired of calling and emailing them. None of the managers contacted me, so on my file that complaint should still be open. I knew it was only a matter of time before I had the problem again. Last Thursday 22nd when there was the heavy wind and rains, I sat in my living room and watched in amazement and dismay at the water stain spreading on my ceiling and then drop onto my floor. I had only ever previously woken up and seen the water damage, but this time I watched it happening. The water was coming through the lighting fixure, and the stain appeared on the wall as well, so it is a health and safety issue, as its obviously going through the walls where there are electricity cables... It has also spread to other areas of the ceiling, so there is obviously different points where the water is making its ingress.

    I reported the issue to the Housing Association the next morning by email complete with photos that I took on Friday 23rd.

    I also stopped my direct debit on Friday 23 (in anger and due to frustration as I knew the problem would have reoccured), and on Tuesday 27 I recieved a letter from the finance department of Affinity Sutton threatening me with recovery legal action if my rent is not paid.

    I contacted the office by phone on Wednesday 28th to confirm that my email was received, and to date, I have not had a reply nor a phone call from the HA.

    Please please please give me some advice?

    OK Wite to the landlord again and explain the problem. Open a separate account for the rent and pay your rent into it . Write to the rpeople who have sent you the letter about non pasyment of the rent and explaint thAT YOU ARE WITHOLDING THE RENT UNTIL THE STRUCTURAL PROBLEM HAS BEEN RESOLVED. aRE ANY OTHER PEOPLE I YOUR BLOCK TENANTS OF THE SAME HOUSING ASSN.? iF THEY ARE AND THEY HAVE THE SAAME PROBLEM THEN GET THEM TO OPEN A SEPARATE ACCOUNT OT PAY THE RENT INTO . All of you send a letter outling the problems and saying the rent will not be paid until the problems are being sorted oout Stress that this is a rent strike and the money is being held in a special account .

      Thank You Seduraed. I have stopped the direct debit, but have opened a standing order for the rent, as I dont want to have problems when the rent is to be paid. There were other leaks, but they have been in the communal areas, one was over my neighbour's door, but that has not re-occured. I did not think to speak to the other neighbours to ascertain whether they have problems ongoing, but I will do so, and thank you for the tip about the finance dept, I will respond to them. However, what about the water seeping into the electrics? Is that not a H&S issue?

        I would contact the Environmental Health Department at your local council, they should send someone round to inspect the damage and then they will write to your HA making them aware of the problems you are having, and problems that may occur if the repairs are not carried out.(Damp, electrical fire, etc.).

        If the HA do not carry out the structural repairs that are causing the problems then the EHD can arrange to have the work done, or you can have the work done if you can afford it, and then claim it back from the HA.
