Some years ago I left my employ for reasons too complicated to go into here. Within that employment was attached a company car wholly finance by the company. The lease and maintenance monthly payments where paid into my account, then I would make payment to the lease company by way of a D/D.
When I left the company I informed the lease company and the maintenance company that I no longer required the vehicle and wished to return it. The maintenance company was the administrator of the account and informed me that I was required to pay £500 excess on the GAP insurance (£525.29) before they would accept the return of the vehicle. Not having that sort of cash available I was forced into not making a claim on the GAP insurance.
The vehicle became the subject of a County Court judgement in which I was required repay the balance of the account after the vehicle was sold, a sum in excess of £4000.
My question is:- If the maintenance company had no intention of instigating the GAP insurance on this account, are they entitled to retain this sum.
