  • Hi Folks New here and need help- Civil Recovery RLP

    Hi People

    Just want to say any help would be great and hi new to this.

    I have read allot about this company RLP. I was shopping today and broke my shopping up, as was getting items for a family member I put items in a bag and forgot to pay for them. At the checkout when I was leaving the store I got approached by security and the deputy manager, asked to go to a office.

    Were they went through my shopping, asked me about the items I did not pay for. It was a genuine mistake as advised to the manager who was asking me the questions. I advised them I would pay for the goods and they refused. Said they are calling the police. They took the goods away that I had not paid for and brought them back with the amount I was potentially going to steel.

    Any way the police came and asked me the same questions. Which I explained to them, in the end the police advised they are not taking it further as it looks like it was a mistake. As I have not been in trouble with the police before. All the police did was taking my details but no action taken from the authorities.

    When I was leaving the manager handed me a letter advising this company will be in touch with me, In relation to claiming for their time used and security officer’s time. As I had to wait for 1 hour for the police to turn up I thought at the time ok and looking into it. I feel I am going to get ripped off.

    Plus the manager advised I was band from the store for life and all their stores. I feel shocked and should I contact the store direct advising of my treatment. By the manager as I feel it was a mistake that went too far. As advised at the start I said I would pay they said no. when the police was there again I said I would pay. But in the end I need to buy the goods from another place.

    If I receive a letter from RLP what should I do?

    As the amounts are high for loss of time

    The store manager advised all the stock has been put back so it will be for their time only. Plus CCTV usage and time.

    Have a look at this thread and simply write back to RLP and the retailer informing them that it was a honest unintential mistake and you had offered to pay and that you believe their actions where over the top and demands are extionate speculative invoicing, Make them a wae that you are fully aware of the following case:

    A Retailer v Ms B & Ms K .

    Then end letter with following statement "Sod off"

    Oh also tell them they do not have your permission to process your data on RLP's sister companys (CIRECO LIMITED) dishonest persons database either. If they do, then you will sue for liabel and you require legally certified statement and evidence that they are not processing your data and neither is that of there sister company CIRECO LIMITED.

      In fact JBB, if you can afford the £10 Satutory fee, i would send a Subject access request under the data protection act 1998 to CIRECO LIMITED demanding they provide you with all data they hold on you and all manual notes applied to your data and details as to why they are processing your data and for what legal or lawful purpose, as well as whom they share the data with. You'd be surprised by their response, as it clearly implies what they say on their website - http://www.integrityscreening.co.uk/about.html

      Which clearly confirms they use the data to tell others if your are dishonest and have history, despite no criminal conviction (which under law of the land means you Honest/Innocent till proven guilty/dishonest) which therefore makes their data inaccruate and libellous if shared with anyone or propsective employers that you have applied for jobs with.

        There are a number of things I have to say about the actions of the security goon and deputy manager. Firstly, they do not have ANY right in law to search a person's bags or person, no matter what they may claim (Their usual is "We have a Common Law right," which is total b*llocks. There is, to the best of my knowledge and belief, no such right or power accorded to security guards or retail managers.) Secondly, the police stated they were satisfied that it was a genuine mistake and, accordingly, no evidence of dishonesty or intent to permanently deprive. If you cannot prove dishonesty or intent to permanently deprive, there is no offence. You could, if you so wished, bring proceedings against the security goon and deputy manager for Unlawful Detention and Trespass against your property, i.e. searching your bags.

        I would be inclined to tell the retailer involved of the decision of the police and that you will not be paying any money to them or their civil recovery contractor as to do so would amount, potentially, to Fraud by False Misrepresentation on their part. Also, as highlighted by Teaboy, in his post, you have the ruling in the case of A Retailer -v- Ms B & Ms K [2012] to use as a weapon against them.

        As for the conduct of the security goon and deputy manager, if you can afford a legal professional, get them to write a very strongly-worded letter to the CEO of the company.

        As for RLP and any claims for security time and CCTV usage they may attempt to make, I would politely but firmly tell them to perform a very difficult, if not physically-impossible, sex act on themselves.

          The store staff have no right to search you or your bags, that is trespass. The police have a power to search upon arrest, but it didn't come to that. You committed no crime. If these idiots try to make a claim against you, fight back. Come back here if you need to.

            After reading more into this I do have a few questions.

            Can this company keep my details and pass it onto other people. As I have not done anything wrong as the police did not take action. I have seen a few things were it can effect applying for a job. I want to know if this is true.

              If they did try to do that, gvien the circumstances, the ICO could have issues with it and you would be in a pretty good position to sue RLP/Cireco for civil damages for defamation.

                As per Bluebottles post, the whole reason i suggest sending a Subject access request is to see what info cireco limited have on you, if they have any at all then you can bet your arse they have you on their dishonest persons database and will share it with prospective employers. As such there actions would amount to Libel, So you could basically sue RLP for basically sharing data with their sister company Cireco alleging your dishonest and sue cireco for sharing or process your data as a dishonest person, when you not.

                  Investigate with the ICO improper disclosure of your personal details to RLP/Cireco by the retailer involved. Go to www.ico.gov.uk where you can download a complaint form and also find the number of their helpline. I would advise you to ring the helpline first. Please note that it does get busy at times so be persistent.
