    Hi members, I complained through FLA re PPI misseling which took place in Dec 2001 by Direct Car Finance who were the brokers introduced to me by Credit Acceptance who still exists as a company in USA but decided to stop business in the UK. The company (DCF) is dissolved in 2010 and were not authorized by FSA until July2010 so I can't complain through FSCS. When complained to 'the funding corporation' who are members of FLA their final response to me, and to FLA was that they are unable to investigate my concerns as they are not the sellers of my PPI policy. They went on to say that the 'funding corporation did not purchase Approved Car Finance (ACF) until May 2003, and in doing so did not purchase all of the liabilities associated with the former company (i.e DCF). Additionally they said, are not linked to DCF to whom I addressed my complaint.
    Credit Acceptance's administrators, Deloitte at Athene Place, London said they've closed the business with Credit acceptance and can't help me (when I enquired about DCF/CA's underwriters). CA USA also said they have no dealings with UK's business. FLA can't help me further with my complaint and advised me to seek leagal advise.

    AVIVA (Norwich Union), whom I believe to be the underwriters (and indeed DCF being it's agent) says they are not responsible for the investigation of the sale of my PPI because the sale was arranged and sold by Credit Acceptance. They continued to say that in the invent I choose to complain to the FOS about AVIVA or any of it's subsidiary company they would dismiss the matter on the basis that they have no responsibility for the sale of my PPI policy. However, they have asked me to contact FSCS whom I believe won't be able to help as the sale took place pre 2005.

    However, I have complained through FOS and they are still looking into it.

    I have been fighting for this since Nov2011 and don't seem to get nowhere. I would hope that somebody in this forum would be able to help me what shall i do next after FLA's final response.

    this is a bog off letter from the financial leasing assocoation

    they were responsible for their members actions on the misselling of ppi pre 2005

    send a letter before action to the FLA in that you have now complied with sections 111 AND 1V of the pre action conduct "practice directions" and a claim will be issued in the small claims court unless dialogue is restored

    who do you thinks pays for the FLA

    it is their members, that is finance companies etc

    the FLA is only their to look after its members interests and they are talking the sir humphrey school of gobblygook to you

      Thank you. I really thought they would look my complaint a little bit deeper than just being a 'messenger'. One of their acknowledgement letters reached me exactly FOUR weeks after the date on the letter!!! Do you know where I can get a template for a 'letter before action' letter?
