    I am a new member here but have been having debt problems for about 3 years now with 3 credit card companies.

    I have agreements with two of the companies by paying hem 1% of the debt although one of them, M&S has since changed its rues and has raised a Default Notice against me.

    The third company, Egg, sold on my debt to Cabot whilst I was still disputing the debt as it had not provided me with a CCA.

    So far i have managed to keep Cabot at bay, as although Egg have now, some 9 months since I first asked for it, provided me with a CCA, I believe it is a fraudulent facsimile. This is because the SAR data they supplied me with at the same time starts with an entry of £xxx without any explanation of how it got on the statement and the date of this entry is the same date as the agreement date. The CCA is dated 2001.

    However, Cabot are now chasing me for payment. I have batted them back with the statement that it is a fraudulent CCA and also that Egg promised to send me a copy of the audio tapes but didn't. I have also demanded Cabot remove the default notice they raised against me when they bought the debt as I have recently found out that although they own the debt they do not have the right to raise a DN.

    Is there anything else I can do to try and force hem to back of and also to get hem to remove the DN.

    Hello and welcome to LB, your in the right place for this now

    I'm not an expert in Debt Collectors, however, how old is the tape of the recording you are asking for, dependant on the companies size is how long they keep the tapes. 02 keep theres for 6 months, some only 3 months, and some dont record every conversation. Ask for the timescale of tape retention (posh speak for how long is the tape kept for?) and if you have paid for the recordings, demand the moneys back if you are past the timescale.
