  • Newbie seeking help

    HI one and all ;-)

Ive just joined up after reading the forums, so im seeking so help on the folllowing problem...

Long story short, I have a CCJ issued (link financial) against me for the amount of 1200 odd pounds, the original amount was double that but because the agreement i had was a joint one the amount was spilt 50/50, and the judgement is for the halfed amount.

However im being chased for the full amount and now have had a letter from the local county court saying that a baliff etc will be coming to the house etc etc.

MY question is can Link Financial chase me for the full amount even the the judgement is for half??

Please can someone point me in the right direction, as ive tried speaking to these idiots and they do not want to know what so ever

Any help would be greatly apreciated

    Many thanks

    Re: Newbie seeking help

    Hello and welcome Denton.

Was the debt between you and a marriage partner?
Have Link Financial also chased the other party?
Are both signatures on the agreement?

      Re: Newbie seeking help

      Hi Thanks for the reply

to answer, it was a ex partner (not married), parted on not the best of terms so couldn't tell you if she is being chased or not, but yes both signatures

are on the agreement and Link have noted this on the original CCJ forms, I have but for the life of me cant find correspondence from a local court saying the amount I now owe is the same amount that is on my credit file..... and not the full amount.

        Re: Newbie seeking help

Can you suspend bailiff action for the present by offering to pay even a massively reduced amount to the court per month? Form N245 http://www.hmcourts-service.gov.uk/H.../FormFinder.do.

You then need to write to Link to enquire whether any other party has been chased for this debt.

If the above advice is wrong or falls short, then we have wonderful people on here who will tell you.

Thanks for the advice, but can Link still chase me for the full amount even though the amount registered at Northampton is half the amount they want??

              Hi

It depends on what it says on the judgment, do you have a copy of the judgment and can you copy exactly what it says on here, leaving the names out naturally.

Well, possibly and probably yes, which is why if you find an achilles heel you can get them on the backfoot a bit. If they have only made an attempt to chase you then that is wrong and that will be a powerful point for you to pursue.
