  • Statutory demand

    Hi there
I've just joined the side. Quick question. In 2010, I have received SD (pushed through letter box) from Hamptons Legal acting for Lowell for Capital One and Barclay Card credit cards. I've snet them a recorded delivery letter, enclosing £1 postal order for each, asking for true copy of agreement under CCA1974. Insted of acknowleding/or sending anything, they sned another letter saying "you're at risk of being made bunkrupt", basically still demanding payments. I did not setaside the SD.
Now, 10.2.12, I received exactly same SD from them. I went to RCJ and filled in forms 6.4 and 6.5, giving reasons that the accounts are in dispute becasuse they failed to provide me with any of the documnets I've asked for. I have also written a recorded delivery letterto Hamptons saying I was going to make a complaint to OFT and to any other authority relevant.
Meanwhile I've received a letter from the court, giving the date of hearing, next Tuesday, it states " the respondent creditor to file and serve witness evidence attaching the credit agreement, statements of account, default notices i relation to the petition debt in the statutory demand before the hearing of this application".
Today, I have received two separate letters for each A/C from Hamptons, exactly the same as in 2010, saying "you are at risk of being made bunkrupt" etc, offering reduced payment, etc.
In any case I will go to court on Tuesday. Any advice? What should I expect? What should I tell to the judge? Any advice will be greatly appreciated.
