  • CCA Request: How Long to Wait?

    Hi

    I'm new to Legal Beagles, so hello everybody

    I would be grateful if someone could please point me in the direction regarding a CCA request that I made back in August 2011.

    The DCA responded to my request in August to say that they had requested the information from their client but also pointed out that as the debt had beed assigned from the OC it may take longer than the 12 days specified in the CCA but confirmed that no legal action shall be considered until the information has been supplied to me.

    I wrote to them again in December and January but there has been no response. I requested a copy of the CCA in preparation to make a final offer on the account.

    I've been in a monthly payment agreement with the DCA for some time and have not stopped this.

    I just wondered if there's anything I can do to move them along a bit, I'd like to try and clear this debt as soon as possible.

    Any help appreciated and thank you in advance.

    If you're wanting to make a F&F, you could try making a particularly low offer on the basis that they cannot supply the original agreement.

      You could try making a request to the DCA under section 97 of the act they should then send you a settlement figure, i dont see why they would have to refer back to the OC for this.
      Otherwise you could send a DPA request to the OC it will cost you £10 but then at least you know that you will recieve something within 40 days

      As per the CCA request
      Really if the account has been assigned to them then they are liable to comply within the statutory time limit, unfortunately the sanctions fo not doing so are now limited.
