Hello everyone I have just registered as a new member, I have been looking for some help and assistance regarding Marsden's Enforcement Officers. I have searched the internet and have read a number of conflicting articles and I am not sure what is correct.
Three weeks ago I received a letter from Marsden's which was hand delivered, there was an amount of £522,98 on the letter, but it did not state what this was for. I rang the number and spoke to one of their representatives who explained what the amount was for. It was for an unpaid tax disc claim from DVLA - I had SORN my car off the road as it was up for sale and my partner moved it off our drive for two days and one of our neighbours phoned up and complained - the car was clamped, i had to pay a large amount of money and pay for a 6 months tax disc, all this was my/partners fault and i had no problem paying for the offense. Nearly a year later i get a letter from the Court saying that DVLA had taken me to Court and I had a fine for £210 . I made a payment plan with the Court, I did not pay the last installment, i honestly forgot, i did not hear from the Court, the next thing was the letter from Marsdens. I spoke to the Court they were dismissive and told me there was nothing they could do to help, i had to deal with Marsden's and pay them direct. I phoned Marsden's back I explained i had spoken to the Court and that i owed the money and asked if i could go on a payment plan, I was advised that it was too late to agree a payment plan as it had been passed to an Enforcement Officer and i would have to deal with him. The Enforcement Officer left me a letter and i called him immediately, he said i was a liar and that i had not contacted the Court, and that he would be round tomorrow to collect payment as the Court had told him i had to pay tomorrow or remove my goods, he then hung up on me. I called him back and politely asked if i could speak the Court to prove i had indeed contacted them and make an appointment to come to the house to sort out the issue, he replied that he would called around at 6pm tomorrow evening . I have to be honest i had a bad feeling about this man as he was very rude and nasty on the phone, he said he would be able to get my stuff whether or not i was at home. I did a bad thing i moved my car to my friends house at 11.00pm after i had spoken to him, i am glad i did as he was banging at my door and shouting through my letterbox at 6.20am. The next five hours passed in a total blur the Enforcement Officer called the police as i would not answer the door. I did speak to Marsden's four times whilst he was banging and shouting to advise that I would not deal with this Enforcement Officer and i would be happy to deal with someone else but this particular Enforcement Officer had called me a liar shouted the same thing again through my letterbox. I was really scared and frightened. I phoned my friend who said I did not have to answer the door, however when the police arrived they said he could have broken in at any time because i was being awkward by not answering the door and he had a distress warrant, the police also said they had no idea what a distress warrant was and had to check. When the Enforcement Officer came in to the house he wanted to see the documents to see the ownership of my partners car, i responded by saying your representative at Marsden's had told me the reason you have sat outside my house for the past three hours was to wait for the DVLA to confirm who owned the car, the police told me the same that he had not called the DVLA and to get the documents and he was hoping to levy on the car. The police also said that he had informed them that i would have a £5,000 bill by the time he had finished with me. In the end my partner kindly paid the amount. The thing that has really upset me is the behaviour of the Enforcement Officer, his attitude towards me and being called a liar. I did get the Court office on the phone to confirm i had indeed spoken to them and the Court also said that the Enforcement Officer could arrange a payment plan with me and to ask. In front of the police I asked he said well yes i could put you on a payment plan but i am not going to as you are a untrustworthy person. - I have put a complaint in to Marsden's over two weeks ago, I have had the standard holding letter, I also wrote to my MP and the Court, my MP has not responded and the Court have sent a response saying that i had to give Marsden's the opportunity to respond , if i did not get a response in four weeks time to contact the Court. Another thing that did bother me was one of the staff from Court advised that a Enforcement Officers job was to be intimidating to recoup the money for the Court and basically all people who owe money are lowlifes and don't want to pay and it is very rare that honest people would get a call from an Enforcement Officer - sorry for rattling on I have never known anything like this and the affect it has had on me is untrue, if anyone bangs on the door i jump!!! can someone advise if i truly have grounds for a complaint and how do i go about taking it all the way to the top?
