    Hi. I'm new to the forum.

    I have a question: what is the right way to deal with a bank who keep me in debt to them by taking bank charges out of DWP payments? Can I stop them doing this? Can I move my account?

    This, as you might expect, is causing great hardship - with the best will in the world I can't live on £10 a week any more!

    You need to put in a Frist Right Of Appropriation request to the bank, and also write a letter of complaint asking for a refund of all previous charges under hardship.

      In addition to the above, getting a CFS or CASHflow statement to them should make them abide by the Lending Code. If your CFS shows financial hardship, they are pretty much duty bound to freeze charges and interest.

      There are people on here licensed to do these - have a word with the site team!

        That letter from BDAC is wrong since the Lending code now replaces what is put on that letter. Hang on while I get the right part of The Lending Code.

          Which makes no reference to the right of appropriation......GRRRRRRRRRRR!!!!

          However section 9 of the lending code might apply in these circumstances

            Are your benefits being paid into an account that is with this bank?
            If so then get this changed asap and have them paid into a basic account elsewhere or a post office account.
            Benefit money is to live on, not to pay greedy bank charges.
            Make a complaint to the bank as well & the financial ombudsman service and hopefully you can get these charges refunded.
            Who is the bank by the way?
