    Hi,

    This is the first time I have used one of these forums, so please bear with me!

    I am having the week from Hell. Yesterday I received a Warent of Execution for an unpaid PCN back in May this year!

    Honestly, these are the events leading up to yesterday. I was waiting for my Tax Disc renewal form to arrive in August this year, It did not come. When I rang the DVLA they told me that they still had my previous address on record. I had moved house the end of 2010, changed everything, insurance, driving Licences, thought I updated the DVLA, but obviously not! This is my first car and first house move so I was learning as I went along! So I updated the DVLA straight away, yesterday the letter from the bailiff arrived!

    When I rang hounslow council who issued the PCN they said all notices went to my previous address! I never received these or any other PCNs or any other motoring fines I may have got.

    This morning I sent off the TE7 and TE9 forms to the Traffic enforcement Center, Im not sure whether this will be successful!

    Now Im totally Petrified that I have other outstanding fines and I don't know how to find out. If I have am I going to be punished with huge fines for making a mistake? This is the first thing I have ever done wrong in my life, never even had a speeding ticket!

    You sound to me like you were very organised when you moved. Are you sure it's you who made the mistake rather than the DVLA? You contacted everyone else regarding the car, so it would seem strange if you didn't also contact the DVLA.

    If it might be their mistake things take a different dimension.

      I agree with labman and the DVLA are known for just this sort of thing.

        Thank you for your replies!

        If I did inform the DVLA I have no evidence to show that I did. I am usually very organised, but moving is stressful and I may have missed informing them!

        I find it strange that I had to send my driving Licence off to the DVLA for validation checks yet they didn't realise that the address for this and my V5 were different when sending out the penatly notices!

        Are they likely to reject my appeal and say it is my own fault?
        How do I find out whether there are any other fines outstanding on my car?

          There is no requirement on you to provide proof that you did change your address with DVLA, although the DVLA will have you believe something different.

          If might not even be your fine, they can and do make mistakes. So I think you are getting a bit ahead of yourself.

            I believe the TE7/TE9 should freeze any bailiff action until the application is decided upon.

            If it were me, I would make sure the forms have been delivered & actioned*, & I would inform the Local Authority & their bailiffs, in writing (email if poss), that this has been done.

              Hi Amy, yes I have read the form. I am going on the assumption that the PCN was correctly issued, I have a penalty number and the TEC were aware of the notice. I have already filed the TE7 and 9 forms to stop the bailiffs taking action! On the Form I stated that I could not have paid the fine as I didn't receive any notifications, I laid no blame on them or myself, just purely that documents were sent to my previous address and proof of this! Should I have told them that I was very organised and changed addresses on everything, so it was logical I changed DVLA records too?

              What I am worried about is whether it is possible there are other outstanding fines and I will get letters from bailiffs in the next few weeks! I only changed address at the DVLA the end of August!

              How did the bailiffs find my new address? On the warrant they say that they are getting the warrant re-issued to this address, so they must have only had my old address!

                Taking a complete stab in the dark here, I would imagine that the reason the bailiff found your new address is because you informed the DVLA of it at the time, just like you thought you did...

                You're trying to run before you can walk, just slow down and let's see how this pans out first, you've done everything correctly so far, so have a bit of faith.

                If anything else happens, then just come back and post here.

                  Yes I should just wait on the outcome from the TEC!

                  I totally freaked out! As you can imagine this is not a good time to be receiving a £400 bailiff letter in the post! Especially when you are a decent person who is usually very positive and law abiding! sigh

                      Good luck on this.

                      Just been dealing with some issues for my son as well with a fixed penalty where a course was originally offered, they made a mistake and its put right now and back to a course.

                      Hope this gets sorted for you soon.

                        I emailed Hounslow council this morning to find out what was happening and whether this was the only outstanding PCN, they replied with this:

                        "In response to your comments, at this stage we are no longer able to deal with any appeals or accept payment in relation to the above case as the warrant has been issued by Northampton County Court.

                        We can confirm that we have received notification of the Out-of-Time-Witness-Statement (OOTWS) from the Traffic Enforcement Centre (TEC) in relation to the above Penalty Charge Notice (PCN). The case has been placed on hold and the TEC will review the case and send you a letter of response in due course.

                        We can also confirm that this is the only open PCN that we have a record of in relation to your Vehicle Registration Number.

                        Kind Regards,"

                        Im hoping this means that this is the only fine I never received?! Now just have to wait!

                            I assume you realise that by taking the speed awareness course, the 3 points are only suspended until and unless he speeds again?

                            If he does speed again within 3 years, he will get hit with the points from this offence and the new offence.

                              Yes cheers Amy, am aware of that, my nephew who works for traffic with a force been drumming that into my son's head..so he had better behave himself!!
