  • Tomlin Order

    please i need some help i have a tomlin order thats was signed and dated back in 2009 i had a loan with natwest that my ex partner defaulted on and i have to repay the loan as my partner went bankcrupt i am a litle confused as i have nearlly paid 11.000,00 off . The schedule of the tomlin order reads as follows
    1. The defendant do pay to the claimant the sum of 16,000,00 as full and final settlemant of the above captioned claim.( The orginal loan was about 20,000.00)
    2. The defendent agrees to pay 302.00 per month with the payment to be recieved on or before the last day of March 2009 and before the last day of each month therafter untill the sum of 11,000.00 is paid.

    I rang them this morning because i was approaching the 11,000.00 mark that i have paid they then told me i have to continue paying untill the full 16,000.00 is paid they said it was a typing error and it should read 16,000.00 can they do this considering it has been stamped by Northampton county Court

    I am persuming it was the claimant that told you this

    Do you still have copies of any paperwork of the original claim that lead to the tomlin order ie. the POC/defence or an application for the tomlin order

    If you have not already rang the court, then I personally would phone them, explain the situation and ask them if they can check what is on their records (if they can still access them)

    If the clerk comes up with nothing then ask them how you can find out how much the tomlin order is actually for as you are not sure if the claimant is just trying to get more money from you
