  • Subject Access Request

    Hi All

Can i sent a subject access request to my solicitor. I know it sounds an oddball question to ask, but i'm still paying for a funding certificate with a case that ended nearly three months ago.
I did ask the solicitor if the court docs were received back from the court and the answer was yes. and that the certificate would be discharged shortly.but due to backlog with her secretary and paperwork could i bear with them . that was in the begining of may.
I contacted LSC today and was told the certificate is still active, I emailed the solicitor and have had no response

My understanding is that you can send an SAR under the DPA 1998 to anyone who holds data about you. However, there must be exceptions I'm not aware of as everyone would be getting their medical records for £10 from their GP.

            Re: Subject Access Request

Well a bit of a sting in the tail to this one. recevied letter from solictor dictated 22th May.

Paragraph 7 of the letter states ( now that the final order has been made . l HAVE applied for discharge of the certificate )

But yet the LSC has stated that as of 26th June no Application has been made to discharge the certificate and it is indeed still live !

So l went through past emails from solicitor and found one dated 26th May which states l have dictated work on your file and you will soon receive a letter and also l will now seek to discharge the certificate.

            OH MY DAYS

              UPDATE

Now had certificate discharged . I bought it to the attention of M.P.
I contacted the Justice dept in London to find out why the delay in releasing final contact court order as l received a letter from the solicitor dated 11th May stating that they were still waiting for document from the courts (case was 7th April).

Justice dept investigated and got back to me stating that my solicitor was served with final order on the 15th April. (naughty naughty)
