I have joined up to seek help on a few debt issues.
A few years ago, I got into arrears with a few credit cards etc. I contacted the CAB who set up a repayment plan and I have managed to keep to that plan.
Most of the creditors accepted it, and continue too. Like a few other examples I have read about, there were some companies who did not.
At the time, I did not now of a site like this or CAG and so I was taken to court by one creditor, who obtained a CCJ against me, but fortunately, they had already agreed a nominal monthly repayment, and, though they got the CCJ for £12000 plus for one payment, I was able to get the judgement amended for monthly payments. Probably the original agreement was not "valid" and certainly the sum was in excess (including fees and some charges) of what was actually owed. I did not know enough at the time to possibly prevent the CCJ. I am continuing the agreed payments, and the DCA who took me to court send me a regular statements, showing the payments made.
Another creditor, Marbles, issued an SD, which I disputed, but as I admitted the debt in court (as before, did not know any better to set aside the SD) they "forced" me into granting a charge on property (jointly owned with spouse). This was a voluntary charge not supported by any court ruling. They said at the time that they would not force a sale. Debt was around £9000. This debt was allegedly assigned to Phoenix.
My bank (overdaft and loan with PPI) also took me to court, I defended, claiming back fees and charges and PPI. The case has been stayed for over two years now.
I also have one other account, a credit card, that has been sold on to a DCA who is adding to the debt on a monthly basis, this according to CRA checks. I have not received any statements or correspondence from them for well over a year now.
Regular payments are made to all creditors on a monthly basis.
On recent checking of my CRA file, a "new" DCA has recently run a check on me, and another DCA has "added" a "new" account to my file, it reads as if I have taken out a new card, which of course I have not!
I will probably be starting threads on some of the above subjects.
