    WATER Co CCJ URGENT ADVICE NEEDED

    Hi everyone ( new to site please excuse any errors ).

    I received a Judgement against me 2 weeks ago. I tried defending the Claim brought by Southern Water, on the grounds that I had an agreement in writing to pay off the debt, even though I kept to the arrangement, they demanded larger payments. I refused and they issued proceedings.
    The County Court Judge was sympathetic, and critical of Southern Waters actions, but stated that he had to issue a CCJ, and refused leave for appeal.
    I have paid my water bills regularly for 10 years +, untill ill health forced me into difficulties a few years ago. The bills have escalated because of a disputed commercial element to the premises, which has an unmetered supply. I have been charged over a £1,000 a year. I am the only occupant Southern Water are aware of my situation, and did not advise me of the many schemes available to get out of this predicament.
    I have been in touch with the Council for Water, but it seems they are unable to help.
    I have spent days searching for a similar Case or legal advice without success.
    I am over 60 without any previous CCJ s. I am considering going to the Court of Appeal.

    Its about time these pesky utility companies were re-nationalised imo. Services we need to survive - like water, electricity and gas - should not be run for the profit of shareholders and fat cat directors. Makes me more red than green this does.

    I have every sympathy for your situation. Hopefully someone who knows how to tackle the utility companies and deal with CCJs etc will come along and advise you.

      Thanks for your support, 160 views but nobody seems interested in replying or giving advice, or further support. Southern Water have got away with it again

        I don't think it's that noone is interested, I think it's a unique problem so will not have a straightforward answer. You don't mention whether the judge ordered what you had to pay? You say he was sympathetic so hopefully may have looked at your IE sheet and set repayments at an affordable level?

          The Judge for some reason changed his attitude towards the end of the Hearing, ( after a visit from the Clerk ) Then he only seemed interested in getting Southern Water the full amount.and suggested they should apply for an Enforcement Order, or if that failed to make me Bankrupt.
          I had already being regularly paying £ 80 a month, but Southern Water would no longer accept this ( ref. my other posts ). THANKS

            sorry to hear about your problems Baker. I wish I could help / offer advice. FWIW, I have a £600 British Gas bill to contend with mate, and on my available income thats a disaster.

              Thank God I'm in Wales. We were 2 years behind with our watr and they never did anything other than nasty letters. Fortunately we're up to date now.

              Would it be worth you contacting the CEO with a well worded letter?

                    Hi Debt Star,

                    The law is no different in Wales my friend, the diference being that DWR CYMRU (Welsh Water to us exiled anglos) is actually effectively a co-operative in that it is wholly owned by its consumers. Hence they are a little more sensitive to the wishes of their shareholders shall we say.

                      Is that true? I thought I was being lucky. So what about Birmingham? ALL their water is supplied from the Elan Valley in Wales?

                        Sorry caspar, being a balck country lad myself remembering the old South Staffs Waterworks Company, B'ham I thought used to be a municipal operation. Heaven knows who owns it now. but yes it is true Dwr Cymru has remained in the ownership of its consumers. Without giving too much away however, where i actually live our water is piped over the estuaries from Liverpool's supplies. Our maintenance is done generally by Thames water as well??????

                          Thanks for your interest , I am afraid you might be missing my point.

                          I am concerned that in the eyes of the Law, there seems to be a different set of rules for water Companies . I have always been led to believe, if you enter into a written agreement for £x a month, with no mention of a review or time limit. then that is a contract ? ( eg a property rental or lease agreement ). I have appealed this to the highest Judge at the County Court without success. I am told I cannot take this Case to the Court of Appeal.
                          This decision will give Southern and other Water Companies the confidence to pursue other people. even in Wales.
