  • Hi Guys, Really need help

    been having discussions! with newlyn on and off for the last five years or so,
    moved home in april although was not able to live in previous property since last october,im not dening that i need to pay the council tax although do find it annoying that a have to pay for the months the flat was inhabital the main question i have is can they send bayliffs to my new home when the debt is from a different address, things are getting messy with them as they are insisting on payments that are impossible to pay please help all advice appricated

    How much is the total debt you owe? How far back does it go? A couple of things spring to mind. Firstly (and don't panic when you read this) yes, they can send bailiffs to your new address to enforce the debt as the debt is still owed. Having said that bailiffs are horrible people and you are better off dealing direct with the council as the bailiffs just pile on fees. This will not necessarily be easy as the council don't like taking debts back from bailiffs and may even tell you they can't. Don't believe them - they can!

    In order to move forward I would fill in the template IE sheet from here then post it for us to look at. Your aim will be to show you are in hardship (income is less than expenditure). Then write to the council enclosing the IE sheet, a sensible proposal for repayment and enclosing a cheque / postal order for the first payment. They will cash it and will contact you regarding your proposed agreement. Make it plain to them that you will only pay them and not the bailiffs.

    If the bailiffs turn up do not let them in, sign anything, or anything. If possible just pretend you're not in. They have no right at this stage to force entry. I'll have a look this afternoon as to whether you should contact them in any way, or whether to ignore them and just deal with the council. Hopefully someone may come along first who knows the answer to that.

    Do your IE sheet asap and put it up here for us to look at!

      Why are you expected to pay council tax on a house that was uninhabitable?
