  • Help with allocation questionnnaire

    Hi - I hope you can help me please. I had a debt with Cahoot who sold it to Robinson Way who have instructed Horwich Farrelly Solicitors. I had letter from HF saying it was precourt, I ignored it as my mum was seriously ill and dying. I then received court info from Northampton Bulk, I acknowledged service. I then filed a defence. Meanwhile I sent letter to HF asking for all the info they have etc (CPR) and then wrote back saying that didnt apply and I needed to send £10 for data request. I ignored that and I have now received forms from Northampton Bulk which I belive is an allocation questionnaire with no information about what an allocation questionnaire is. I do not know how to proceed.

    Some background - In December 2008 I sent letter to RW asking for copy of credit agreement, eventually I received this but it did not appear to contain all the correct information, so I wrote again. they then instructed HW. I should point out that I have never received a default notice for this debt. I had been paying cahoot on a monthly basis an agreed sum without interest for two years and then out of the blue they sold it to Robinson Way.

    hi honey, sorry to hear about your mum ((((((((((hug))))))))))).

    Apologies for delay in reply we had some problems with the forums yesterday.

    If you are able to scan up a copy of the agreement and post a copy of the text in the pariculars of claim on the original claim form and the defence you entered then we should be able to sort the AQ out.

    an AQ is quite straightforwardly information to the court as to how the case needs to proceed, if theres nothing unusual about the claim then it will be very straightforward without any directions, and just information as to dates unavailable/wheelchair access and the like.

    how much is the claim for ?

    and try not to worry - you will probably end up with an installment order for the same amount you were paying cahoot under your agreement.
