  • Further Advances (FSA or CCA)

    Hi
In need of advice!Help Please !
Have been in dispute with previous Mortgage provider since I re mortgged 2 years ago. Part of the Mortgage was not redeemed for which the previous provider admitted liability . This was essentially a further advance , with a different account number taken out during the term of the old mortgage. All Charges against my property were discharged with the main mortgage on changing providers. I was not impressed with the previous providers behaviour or attitude over this matter and I involved the Ombudsman service . My issues were that they immediatly listed this as a default with credit reference agency despite being clearly in dispute which from my understanding puts them in breach of the banking code . They refuse to amend the credit refernce issue until I pay up and I refuse to pay up until they rectfiy the credit reference.
My question which neither FOS or FSA or OFT can give any susbstantiated answer (which I find quite incredible ) is who regulates a Further Advance ? I know that if it is a second charge this sits with CCA . But is a Further Advance with a seperate Account Number a second Charge ? Secondly as this is now an unsecured loan does this now sit with CCA or remain with FSA ? Thirdly I made an offer of 0% interest with reduced term and a respectable repayment plan per month which they have refused. In my view I should not suffer financially as a result of the banks error. The above error leaving me with a loan which was meant to be remortgaged and with no ability to obtain further credit or another mortgage due to the above bad credit reference. A bad credit refernce through no fault of my own !

Can anyone advise ? As I am going crazey in not being able to get some straight answers .
