    Hi, I’ve just been hand delivered a letter for termination of my contract of employment due to gross misconduct. My employer is saying that another employer said I said something that I haven’t. Is there anything I can do? I believe it’s a vendetta to get me out as I am always complaining that they are not following correct regulations when fitting windows . I’m FENSA trained and know the regulations but when I raised them with my employer that had no clue and refused to follow the correct regulations. I also stood up to the boss when he spoke to me out of turn and he didn’t like it.

        The person who says I’ve said something about the boss is the bosses daughter in law who is the receptionist for the company.

          Unfortunately with less than two years service you can be "fairly dismissed" without a disciplinary process being followed, unless there is anything in your contract of employment that states that the disciplinary process is contractual (highly unlikely). Alternatively check the disciplinary process to see if they have set out a shorter process for staff with less than 2 years service.

          The only criteria your lack of service would be considered an automatic unfair dismissal, would be if there was any potential for discrimination on the basis of a protected characteristic.
