    I have received court documents from Sandstone legal who are chasing a claim from Fast Track Reclaims,

    Particulars of Claim: Fast track reclaims is trying to claim money from me after a self assessment tax claim, this is due to the fact in 2022 I asked them to support on getting money returned to me for a working from home tax claim, I got an £80 refund from HMRC which was sent to fast track reclaims and I was never sent this money. (They owe me £80) Now they're claiming two years later due to a tax refund I got because they signed themselves up as a deed of assignment without my permission- On top of this the N1 form they sent me is for a PPI claim which was incorrect when I spoke to a lady there she said we will just change that, even though she said it was already submitted.

    EXC I don't know if this is something you can help with, as it's to do with 'claims, PPI etc', company acted without the authority from the OP.

      Sorry, CMC tax claims aren't my thing I'm afraid.

        Wait until you receives the Claim form from the Court.

        a) First Acknowledge Service of the Claim, you can do this online via MCOL, this will give you 28 days (plus 5 days postal) in total to work on your defence. It's best at this stage to defend the whole claim.

        b) Send a SAR request to Sandstone Legal, they have 30 days to provide all the data they hold on the account. Make sure you get Proof of Postage.

        c) Send a CPR 31.14 request to Sandstone Legal, they have 7 days to provide all the documents they are relying on to make the claim against you, again get Proof of Postage.

        d) This is an example Defence, start looking at it, don't fill or file it with the Court or their solicitors yet.

        Don't speak to creditors, solicitors etc over the phone, everything in writing. Keep on top of this, especially dates for filing defence etc. Workout when your Defence is due, 28 days from the date on the claim form. If you can post on the thread 5 days before it's due we can help with your Defence.

        The information provided in post 1 is all over the place.

        The following asks you to copy what's on the claim form, but you've given your version of what's happened,
        i.e. 'Particulars of Claim' etc.

        None of it makes sense.

          - Apologies I was doing it on my phone, The company Sandstone Legal are trying to get me to pay them as a fee for Fast Tracks reclaims services, which were never rendered. I asked them back in 2022 for them to complete an assessment to see if I was owed any money on a government scheme to refund taxes for working from home. It was a quick online form, which I completely forgot I did, fast forward to 2024 they are now trying to get money from me for a self assessment claim I did this year in July.

          They started calling me and emailing me, saying I owed them money I just presumed it was a scam, however after deep diving, it seems this online form I completed was a contract that allowed them to act on my behalf with HMRC for all claims, where they would then get a fee (It doesn't say this on the contract) - Since I allegedly signed this contract back in 2022, they haven't attempted any contact, this includes no contact on a refund I wasn't aware I got from HMRC on the initial claim which it seems they have kept. The first time they contacted me since I allegedly signed this online form was in July this year to say I owe them money, because HMRC must of contacted them thinking they were the company dealing with all claims.

          HMRC have since confirmed that the deed of assignment has been removed "Rendering void assignments of income tax repayments"


          I also spoke with HMRC on the phone and they said Fast Track reclaims are black listed with them,

              1. The Claimant is Sandstone Legal Limited who, on 7 October 2024, purchased the outstanding debt from Quickly Finance Limited t/a Fast Track Reclaim ("Fast Track Reclaim") and at the same time, were assigned the legal and beneficial rights.

              2. Fast Track Reclaim are an established Claims Management Company and identify possible PPI/Concealed Commission, Packaged Bank Account and Tax Refund claims on behalf of clients and pursue compensation that may have been payable.

              3. The Defendant is a client of the Fast Track Reclaim, who engaged and authorised FTR to deal with HMRC claims on their behalf in accordance with the terms and conditions of service agreed with Fast Track Reclaim.

              4. Fast Track Reclaim duly provided its services to the Defendant in accordance with its terms and conditions of service. Fast Track Reclaim services were concluded for HMRC on the 17/07/2024 when, as a result of the benefit of Fast Track Reclaims services HMRC made settlement offer(s) to the Defendant.

              5. Notwithstanding demands from Fast Track Reclaim and letters before action sent; the sum of £719.45 (inclusive of interest) remains unpaid and the Defendant remains in breach of Fast Track Reclaims terms and conditions of service.

              6. In addition to the invoiced sum due, the Claimant claims interest at a rate of 8% from the date the invoice became due until the date payment is made. For the purposes of this claim, interest has been calculated from 17/07/2024 to 16/12/2024 in the sum of £23.89.

              AND THE CLAIMANT CLAIMS
              1. The sum of £719.45 pursuant to paragraph 5 above.

              2. Interest in the sum of £23.89 , already included in the above paragraph pursuant to paragraph 6 above.

              3. Further interest upon the outstanding sum at the rate of 8% per annum pursuant to s 69 of the County Courts Act 1984 at a daily rate of £0.15 until Judgment or sooner payment.

              4. Costs and court fees.

                  Hi Exc, I can see on other threads you have offered some support, for companies having issues with Quickly Finance, they're the same company as Fast Track reclaims. Maybe you have solved a similar issue where companies have obtained a signature under false pretenses then continued to charge for a service that hasn't been rendered. They also didnt make me aware that they were my contact at HMRC

                      All I can say is, if you file a defence on the basis that you didn't provide them with your informed consent to claim tax refunds from HMRC and put them to strict proof that they did, you have a good chance that they will discontinue the claim. There's a thread somewhere that demonstrates that. That's all I can say.
