  • Apprenticeship redundancy

    My son (23) has been made redundant from his electrical apprenticeship job. He started in September 2017 and his last date of work was 8th November 2024, so just over 7 years. It been a long time I know, but with Covid and cancellation of exams, his boss not allowing him time off to go to college as too busy etc, he’s nearly there, just got his AM2 to complete. We have spoken to his training provider, JTL, and hopefully he will be able to sit his AM2 exam very soon. My question is, is he be entitled to any redundancy pay? He has asked the question and been told only 1 week as only statutory from the age of 22, nothing from when he was 16-21, is that correct? I thought it was 0.5 weeks for each year. Also he has a commitment and training statement from JTL which is signed by my son, his dad, training provider JTL and employer which states his actual contracted hours are 38 hours a week. He has never received a contract of employment from the company, which I now believe he should have. They are saying it was a verbal contract. Also would he be entitled to any notice pay? (7 weeks)? We have emailed his manager for a breakdown of his final pay on 4 occasions and not getting any response. I think they think he is young and has no clue. He was on £500 a week. Should they be putting all this in writing so he knows exactly what his entitlement is? He has been working on new builds since he started and works on his own doing 1st, 2nd and 3rd fixes. There are 14 other electricians in the company who all do the exact same job. Work has slowed down over the last few weeks and he has been laid off for 1 or 2 days a week. There has been no consultation or previous meetings, just got called into the office on 1st November told he is being made redundant by the secretary and handed a letter to say his last day will be 8th November. Can anyone advise please? He is only 23 and this has really knocked his confidence, he has no savings apart from what he has saved in his Lifetime ISA. He received a payment last Friday which was for work done the week before but nothing else.

    If your son is under an apprenticeship agreement then the redundancy payment for your son should be calculated at the statutory rates of:

    * half a week's pay for each full year of service under 22 years
    * one week's pay for each full year of service 22 or older but under 41

    In terms of notice (either worked notice or pay in lieu) he is entitled to 7 weeks.

    Payments due under redundancy should have been notified at the latter stages of consultation with him, which from what you have posted, appears not to have happened.
