    I am helping a friend who has been chased now for 10 years for a debt that is not his. When he finally asked for help I submitted the request for the CCA. They have sent an agreement with the same surname, but it is signed by someone with a totally different christian name. My opinion is that this is a clear breach of FCA guidelines and also a potential breach of GDPR. For 10 years the idiots have not listened to my friend.

    Can I please have some suggestions of how to word a response and what action to take via the FCA or Information Commissioner?

    The first thing to do is send a letter of complaint to the Creditor (the owners of the debt), follow the complaints procedure on their website. Once your friend gets a final response (I believe that your friend should be offered compensation, but I don't know all the facts, the communications etc), if they still aren't happy, they should lodge a complaint with the FOS. You can complaint to the FCA, they will log the complaint, but won't investigate.

    In the complaint, who the person is, why they are not the 'debtor', facts - they have been chased ect, it would have effected their credit, this has caused them to be stressed etc. and what you want them to do. You can state that if the complaint isn't resolved then a complaint will be made to the ICO.
