  • Employment contract variation

    Hello, I have been with my current employer for 3 years and they want to standardise my notice period from 1 month to 3 months and I would like some advice on this because, on one hand, it would give me better "protection" (for want of a better word) if my role was made redundant, but on the other hand it might affect me negatively if I chose to leave for a new role since there are some employers who won't want to wait 3 months for a new starter.

    The current notice is: minimum of 1 month up to 5 years' service then + 1 week for every year of service after that, up to a maximum of 12 weeks/3 months.

      Hi Atticus, sorry, I should have mentioned but didn't want to write too much in my first post (some other forums frown on that) - I'm looking for advice on what to consider when accepting this variation and any questions I might want to ask my employer (AFAIK, all they've said is they'd like to standardise everyone's contracts but nothing about any consideration if it has a negative effect on people after they've agreed to it).

        I think you have identified the key points. You need to weigh up those pros and cons for yourself.

        Will your employer give you any "consideration", i.e. something in exchange, such as more pay, holiday, or other benefit?

          I had a 1:1 with my line manager today and we discussed this - from what he told me, they want to have everyone in our department be on the same notice period in our contracts, so I did mention the "consideration" aspect and he said that is something he might have some remit on.

          He also agreed about variation of contract (ideally) being accompanied by "fresh consideration" (sorry, that's a term I remember an American YouTuber I follow mention in one of his videos where he discussed a NDA being modified under UN law, so I wanted to ask someone more knowledgeable before bringing that up.

          I'll have a look over the contract as is and think about it.
