  • Welsh Water / Dwr Cymru

    Hi All,

I wonder if I can ask for some assistance?

Welsh water have been carrying out a number of underground pipe repairs in my town (Brynmawr) where diversion signage has been placed across the town re-directing traffic to the correct and safe route to and from their homes/businesses, however it is human nature to find the quickest route no matter what signage has been put in place hence my dilemma.

The lane in which leads to the back of my property has and continues to experience large volume of traffic and vehicles not suitable for what we call a rat run/lane resulting in cracks to my perimeter wall and the subsidence of my electric gate post and motor requiring a costly repair.

Welsh Water's stance on this is that they have put diversions in place and they cannot be held accountable for vehicles not abiding by these diversions and that I should claim on my house insurance for the damaged caused by the increased and unsuitable traffic.

I am not living at the property at present and so I do not have insurance, however why if I did have insurance claim for damage caused by the road closures put in place by Welsh Water where the subsidence is caused by increased and unsuitable vehicles?

Welsh water themselves have used this lane to access the adjoining road where repairs are taking place and yet they wont take any responsibility for the damage I have witnessed.

The road was closed off for many years on the opposite end due to subsidence and a long lengthy court battle took place with regard who is responsible (Insurance & Council) and I don't want to be in the same position if my perimeter wall collapses that runs adjacent to my rear gates.

    Kind Regards and Thanks

Is this lane a public or private road?
