I have just submitted my Insolvency Service dividend payment claim v my current SIPP investment company Store First Ltd. ALL preferred creditors have now been dealt with. Could you please confirm if either or both of the following will now make me a further preferred creditor please;
A. My legally binding yet never enacted FOS deliberations against my then SIPP providers Stadia trustees Ltd. Never enacted AS Stadia bravely ran away into Insolvency when they received them. These deliberations told Stadia to repay me my entire lifes pension plus the full values of the standard x 20 years of my pension. The total value of the deliberations are and were in excess of £300,000. Whilst against Stadia these deliberations are totally and solely linked to my investment at Store First Ltd.
B. My FSCS confirmed uncompensated losses of £47,500 still valid and recognised today. Against Stadia yet and but again totally and solely linked to my investment at Store First Ltd.
I am no legal type but was rather hoping that my FOS deliberations make me a victim of TORT and so a preferred creditor?
I've read somewhere that due to a change of law in 2014 via a Bank and Building societies order that any person who has FSCS confirmed uncompensated losses is to be considered a preferred creditor and from 2015? My FSCS award came in early 2018.
Finally if I do get the preferred creditor status will I get the full value of my claim? I understand that there is 3.24 Million Pounds in the pot remaining. My claim total is £477,600.00p to include my previous FSCS award of £50,000 back to them and £62,000+ in un-capitalized interest.
Should I qualify for the status but then NOT get the full claim amount I am struggling to see the value of the status to be honest with you?
