  • Help: County Court Interim Charging Order

    Hi, just joined as the forums seem a good place to get good reliable advice.

    Have received a letter from Christopher Pinnion & Co solicitors with an interim charging order for £xxxx from Southend County. The claimant being Tessera Portfolio Management. Don't know what this is about.

    Could anyone suggest the best forum for advice?

      Tessera are a many headed DCA.

      What EXACTLY have you received from these Solicitors ?
      Is this an actual Court claim or enforcement of a judgement ??

            have received letter enclosing Interim Charging Order.

            Charging order states that I have not responded to previous application of the claiment (Tessera Portfolio), but did not receive this.

            The court order I have received now states that the application to make a charge on my property will be heard on 1 May 2009.

            I have spoken to the court and requested copies of documents, and all they sent was another copy of the land registry application form.

            Nothing indicates where the debt may have originated.

                Curly / Nattie or anyone who can assist. Below is the transcript of the letter from solicitors and the Interim Charging Order. I have not made any contact with solicitor at this stage as I don't know where the debt originates. Any assistance/guadance very much appreciated.

                Letter from Solicitor:

                Dear Sir,

                Tessera Portfolio Management v self

                We enclose, by way of service upon you, an Interim Chasrging Order and application supporting document.

                Please acknowledge receipt of this letter and enclosures.

                Enclosure 1: Court document

                Interim Charging Order

                In the SOUTHEND COUNTY COURT

                Claim No: XXXXXXX
                Claiment: Tessera Portfolio Management ltd Registered Address 30 City
                Defendant: self

                On 12 February 2009, DISTRICT JUDGE DUDLEY considered the application of the claimant ('the judgemenmt creditor'), from which it appears:

                a) a judgement or order on 15 January 2009 ordered the defendent ('the judgement debtor') to pay money to the judgement creditot;

                b) the amount now owing under the judgement or order is £xxxx (including any interest and costs); and

                c) the judgement debtor is the owner of, or has beneficial interest in the asset described in the schedule below;

                and the court orders that

                1. The interest of the judgement debtor [my name] in the assett described in the schedule below stand charged with the payment of £xxxx together with any further interest brcoming due and the costs of the application.

                2. The application will be heard at 3.30pm on 1 May 2009 at Soutthend County Court, Southend-on-Sea Essex SS1 2AW when a judge will decide whether the charge created by this order should continue (with or without modification) or should be discharged.

                      In that case you need to get the original judgement (CCJ) set aside.
                      You need to do this NOW.
                      Have a read through this for pointers: Removal of CCJ's - Valid reasons to have your judgements set aside

                      Points 1, 4 & 8 certainly come into play here I believe.

                        Many thanks for this advice. Will look through the info on CCJ's and get back to you if need further guidance.

                        I have received separate documentation from Land Registry regarding the ICO. Any advice on how to defer this until things settled with the court? Will a simple letter to them disputing ICO be sufficient? or should I send something more substantial? This need to be done before 20 April 2009, which is before proposed court hearing!

                            I have no idea what debt it is about. I have contacted the county court and have been sent all the documentation this company has submitted (Tessara). I have read everything sent to me and cannot find any reference informing of where this debt has come from. The letter I received last week from Tessara is the first correspondence I have seen from them. I am so worried about it all and would like to contact this company for an explanation (just to inform me as to whom did i originally get into debt with), but i could do with advice beforehand.
