  • Cabot chasing a debt but CCA request said unenforceable

    I sent a CCA request Cabot in May for a RBS card debt, they replied saying that they could not produce documents and the debt was unenforceable until they could do so. Since then I have had constant phone calls text messages and letters. I made a complain. They offered me £50 as they did not stop calling at the time of my complaint they didn't follow their own procedure. In the letter they say that they own the debt since July 2017. I have not ever paid them since then. They have not produced the paperwork for the CCA but now say the debt is enforceable.
    Is this correct?

    July 2017 is over 7 years ago so if you are sure you have paid them nothing and have not acknowledged to them in writing that you owe the debt during that time the debt is now statute barred. Statute barred after 6 years and unenforceable.

    Do nothing unless and until they come back to you. If they come back trying to get you to pay something don't waste time with requests for the CCA or anything else just send them our Statute Barred Letter. Get Proof of Posting.
