  • Care Home Invoices

Problem. I Hold Joint and several LPA for finance only with another family member for mum who is in a care home. The other LPA signed the contract with the care home, as mum has Alzheimers. I notice inconsistent payments to the care home on bank account and asked Care home for detailed invoices as LPA. Firstly, care home manager referred me to The other LPA to provide them. The other LPA declined to send them to me. (We are in dispute, as I know that mum has sufficient finance to be in a better care home with more facilities). I went back to the care home manager who refuses to send me the information that I have asked for. QUESTION. Does the care home manager have the legal right to deny me that information, since LPA is joint and several, should he not be obliged by law to treat both attorneys the same?

    Hi Judithgate48

    Welcome to LB

You could send the the Care Home a Subject Access Request, you may have to provide proof of your identity as well as LPA details.

The problem may be that the other attorney did not sign the contract with the care home on your mother's behalf as her attorney, but in his/her own name; if so, he/she is the care home's client.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf
