  • Amazon refusing to give insurance details of driver

    Hi,

I'm wondering if anyone can give a bit of advice/guidance about how to proceed.

On the 10th June 2024 my partner and our 20 month old son were crossing the street where they live, this street is essentially a cul-de-sac. There was an Amazon van parked at the end of the street, my partner and our son who was in his buggy had just crossed to the other side of the road some 30 feet away from the van.

The driver had returned to his vehicle and reversed into them and knocked over my partner and the buggy containing our son. They sustained injuries from this. The driver left the scene after protesting he did not see them and did not leave any insurance details or even report it to the police or seek medical attention for them.

The police were called by a neighbour and an ambulance dispatched, they both attended A&E. The police traced who the driver was via Amazon and he is being dealt with by the police and the safer roads unit. Amazon are making me deal with a company called ARC for a damage to property and refuse to deal with any injury claim. Both they and Amazon refuse also to give the insurance details of the driver both keep referring me to the other for information.

I have contacted the Police and they have told me that under sections 170 and 172 of the Road Traffic Act that they have to provide these details. However, I am getting nowhere explaining this to Amazon and they stick to the same line which is to speak to ARC who have point blank refused to engage with me about the insurance company.

Does anyone have any advice about how best to proceed and who I should contact about this?

Ask the police to tell you. They know who the insurer is and you have a legal right to the information.
