  • Small Claims Appeal - Urgent Advice Please!

    Please could somebody advise me?


    I’ve recently taken an online estate agent to court and won my case (a money claim). I’ve been awarded damages, interest and court fees, though the total is only half what I was expecting.


    I would like to appeal the amount of compensation (not the decision itself) as the grounds for awarding the lesser amount were factually incorrect.


    The claim was for less than £10,000 and was heard on 3rd June 2024. The defendant has been given 14 days to pay (i.e. before 16:00 on 17th June 2024).


    I've been advised I need to apply for permission to appeal (I did not ask at the hearing), given an N164 form and told to pay a fee of £142 when I submit the form.


    QUESTIONS

    1: Do I have 21 days from the court hearing to file an appeal (even though an order was made for the defendant to pay within 14)?

    2: Can I still appeal if the defendant has already paid the funds into my account (I don’t want to risk forfeiting the money I’ve been awarded by NOT accepting it within 14 days, only to find permission to appeal is rejected.

    Similarly I don’t want to accept the lesser amount and then be told that by accepting it I have no right to appeal. None of the court staff I have asked have been able to answer this basic procedural question!!

    3: Will I have to pay for a transcriber if the money claim was for less that £10,000? I’ve been told I will, but read the opposite. It was 2-hour hearing with 30 minutes summing up so paying a transcriber could negate any benefit to appealing.

    Any advice would be greatly appreciated.
