  • Pre-emption

    Good morning
    help needed please
    I have a chalet with a pre-emption on it .
I asked the Freeholder if they wished to purchase my chalet as my lease .
which I had a reply that they didn't wish to purchase and wavererd the pre-emption.
i then found a buyer and instructed a solicitor .
Everything was going well and we were only 2 weeks away from purchase completion.
Then the Freeholder decides to activate the pre-emption...? ( just decided to change there mind )
i wasn't happy but acording to my solicitor there was nothing i could do but to now sell to the Freeholder.
Then after my solicitor sent the new contract to the Freeholder straight away, three weeks later he decided to pull out of the purchase and has now again withdrawn the pre-emption clause.
I've now lost two sales and I do not think this is right .
I would really like to have some advice in my situation please it would be much appreciated
    Thankyou all for your time
    Kind regards Adam

I would want to look at the documents to see whether the freeholder became bound to complete the purchase when he "activated" the preemption, and therefore whether you can compel him to complete and/or bring a damages claim against him.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf
