  • UKCPM - permit parking

    Hi, I’ve had a fine from UKCPM, for parking in a car park that belongs to a private property where you either have to be a resident or a hotel customer ‘you have to pay £5 a night’ (if I knew I’d rather pay £5 a night than parking fines, but you need to go every night and remember what time, which is very long). I’ve recently moved to the property so I am a resident and nobody has gone through the parking procedure with me, the other residents said I can park and I won’t get a fine since I am a resident. I’ve appealed to UKCPM which they have rejected. And I now need to appeal to IAS within 21 days. So let’s say 14 May latest.
    I’ve seen quite a few cancelled charges here so I’m hoping the best.

    Hardly worth appealing through IAS as they are far from independent.

    Can you please post up, (first removing your identifying details but leaving in all dates & times) copies of all Parking Charge Notices (not a fine!) and photos of any parking signs.

    As a resident does your lease or rental agreement mention parking arrangements?

      Before I proceed with whatever, I just need to know should I just pay as 99% will be refused or 99% would be cancelled.

      there is no mention of parking conditions on my agreement however, UKCPM have fined everyone in the car park for parking in their own space. As I’m still waiting for UkCPM to send me my permit I’ve parked in a hotel bay which they’ve told me that they will put my car on their system, which clearly they have not.

      I’ve uploaded the charge notice and the entrance to the car park, where you need a key fob to enter or a customer of the hotel.

      also a few days ago a BBC news reporter came to the car park because of these fines, he told us that people have paid for parking in the hotel and they have still been sent a fine.

        The wording of the sign cannot be read on that photograph!

          I suppose in your appeal you identified the driver, which might be a problem.
          On the other hand the Parking Charge Notice (not a fine but an invoice!) is deficient, and so challengeable if it came to a court claim

          I certainly wouldn't pay but would risk court.
          If it goes to court and you should lose added costs are very small, but on the other hand UKPCM will be out of pocket even if they win!

          How can you access that car park if you need a key fob but aren't authorised or haven't been given access by the hotel?

            The car park is mainly for residents, which I am one but they haven’t given me a permit yet as I’ve just moved in. To access the car park with a key fob, I have one, as it opens my front door aswell.
            also the sign on the photograph was just so you can have an idea of the entrance of the car park.

            Ive uploaded one of the signs, but when I will take a photo of the other one and upload later.

              That notice only applies to Premier Inn guests so doesn't apply to you anyway.
              look forward to seeing the appropriate sign.
              An idea of how many, their distribution and ease of viewing might be useful.

                  Those notices aren't capable of forming a contract.

                  I don't understand the situation regarding parking.

                  Presumably you have a lease on a flat, but it does not include a right to park but residents get free parking?
                  When you signed up were you not told about the parking arrangements, or did you just hope there would be a space?
                  The signs don't appear to indicate how you obtain a parking permit, so how did you find out?
                  You said you found out from other residents, but have you asked the letting agent about the situation?

                  What does the entrance sign state?

                    In my agreement it says you can park in a spot with a permit, I was never told how and where to get this permit hence why I’ve had to ask other residents, they’ve told me to park in the hotel bay until my permit arrives which still hasn’t arrived. I’ve asked the hotel to make sure I’m allowed and they said they will put my reg on their system as I am a resident so they didn’t take any payment from me.

                    when viewing the flat I haven’t been informed about the parking and that I will be emailed about it which never happened.

                    to access the car park it’s only for residents and hotel customers which they have to pay to park. You either have a key fob or give the hotel your booking number to access the car park.

                      have you complained to the letting agent and landlord, and ask them both to (a) get the permit for you and (b) request they get the PCN cancelled
