Hello all, a quick question. I have been dealing with Lowell - the joys. They are trying to obtain money for a debt that they brought / cleared (very nice of them to clear it for me) The original debt was £300, I'm guessing they brought it for around £180, but sill trying to claim the full amount, the questions I have is the following:

Can they do this, and if so under what law?
Do I have a contract or agreement with Lowell?
Can I request the amount they paid for the debt? - if so how do I do this
Can I use Section 21 TA 1968 creates the offence of blackmail. The offence is committed when a person with a view to gain for themselves or another or intending to cause loss to another makes an unwarranted demand with menaces.?

I have asked them for the legal teams emails so I can take it to court

    Hi John

    Welcome to LB

    a) Can they do this, and if so under what law?

Yes, they've bought the debt (for pennies), under the Law of Property Act 1925.

    b) Do I have a contract or agreement with Lowell?

They've legally bought the debt, it's been assigned to them, so yes there is a 'relationship'.

    c) Can I request the amount they paid for the debt? - if so how do I do this

No, they simply won't tell you, they will state that it's commercially sensitive information. But probably the cost of a couple of large pizzas.

    d) Can I use Section 21 TA 1968 creates the offence of blackmail. The offence is committed when a person with a view to gain for themselves or another or intending to cause loss to another makes an unwarranted demand with menaces.?

You will be wasting your time / money, they can connect the dots.
