    Good afternoon

    I am feeling rather despondent. I have sent three affordability complaints:

    Nationwide have rejected it stating: 'We cannot see we have done anything wrong';

    Shop Direct/Very have written: 'Shop Direct Finance Company considers this complaint is outside the jurisdiction of the Financial Ombudsman Service' (last credit increase was in 2017). In addition, Lowell Financial, who bought the debt in 2020, have ignored my complaint against them which points out that I have been paying this debt via Step Change for 6 years (no spending at all) and the current balance is higher than the defaulted balance they recorded 3 years ago. Neither company will tell me what the original balance was when I first got into difficulty in 2018.

    Link Financial (who bought the debt from Barclaycard) sent a long Dispute Review and Conclusion Form. They maintain they have provided a complete CCA (followed by lots of legal talk) and the debt is legally enforceable. No credit limit has been provided which they say is fine. Irresponsible lending isn't going to be upheld as they say the original lender (Barclaycard) are responsible lenders and they conduct all necessary checks prior to accepting an application. It was my responsibility to inform Barclaycard the I was struggling mentally and financially. The default om this account drops off next month. How important is providing the credit limit?

    Would you suggest I can I do anything - i.e will the FOS be likely to look at the cases given these responses? Please kindly advise

    It doesn't cost you anything to find out. Lodge the complaints online.

    Send / email a SAR request to to these companies, they have 30 days to respond to your data request, you then build your case with the data provided.

      Hi I am in same situation with nationwide got the reply today saying they don’t see what they done wrong so not upheld so what’s best route to go with this ?
