Elderbridge loan company want to return my payments?????

  • Elderbridge loan company want to return my payments?????

    I took out a loan secured on my house with First Plus, Elderbridge took this over.

    For the past two years, I have been in dispute with them, as to whether I owe them money as I do not have a contract with them. I asked for the following on numerous occasions to no avail.
    • A copy of the relevant and lawful Terms and Conditions.
    • A true and certified copy (Not photocopy) of the Deed of Assignment (NOT Notice of Assignment);
    • A true and certified copy (NOT photocopy) of the Original Note (Credit Agreement);

    In February this year, I had a court summons for repossession of my property, due to my husband’s ill health, I recently under duress, paid them the arrears.
    I received a letter today from Elderbridge stating that if I do not prove where I got the money from within 7 days, they will have no alternative but to return the money and refuse any further payments.

    I am baffled, they have been hassling me for two years, they have the money and now want to return it?????

    Any advise would be so much appreciated.

      I would raise a formal complaint through their complaints process in the first instance as this situation seems to me to be quite absurd, and you have been treated quite unfairly it seems for over two years.

      On the issue of the payments, they may have to check the source of funds for a number of reasons, its difficult to say without knowing their reasons for seeking clarity.
