  • Easement and row of terrace house

The Law do not goes into no man land between private properties boundaries, between "Public" and "Private" places.
Presently, the community is going through expensive litigating over the their easement running at the back of the bottom of our gardens. Cost approaching £ 60,000 over a 3 foot wide a century old pathway that two neighbours abounding the entrance has taken it by force, harassments, assault, and mysterious property assaults for anyone who dare cross them.
There are a lot of easement up and down the country at the back of terrace houses, there are a lot of land being annexed by many people who wanted to extend their gardens or just wanted alternative side entrance and among developers/landlords/DIY Property Dons attempting to combines terrace houses abound an easement, turning two terrace houses into one big multi-occupant building, or worst in our case, into Hostel for Migrants labourers who do couple months of work, have some fun, do some crime, and move on.
It appeared to me, there is a serious societal iceberg of a problem when community turned to the court for solutions, or worst when most just given up and a few individual fight on for community asset laid down a century, now long abandoned or forgotten or just are just not up to a fight. It hardly make sense you have to sell your house to fight over 3 foot wide piece of waste land with an alleyway.
But there are many such situations like us in and round London, in around any major city.
There are also many who do not wanted to see the Land of this country taken by brute force. Yet, it is happening right under our noses. I have experienced a complicated set of Laws;- from Criminals, Civil, to antiqued Land law, from Magistrates Court to High Court to antiqued Equitable Courts, none of them can offer a one stop solution or a consistent answer. Our case has bounced from Magistrate to County Court to High Court, to Tribunals, god know where to next. Nobody seemed to want to hear the simplest of all cases.

Therefore, I believe there are no provisions in Law to prevent some one who is bent on taking your century old easement running at the bottom of your garden and waving at you from the bottom of your garden in in some dark nights. We even had burglaries by appointments. The Police called it "Civil"/dispute between neighbours matter, Council called it "Private" and not on their list of properties, MP don't even bother to reply. Safe neighbour team can't get into the stolen easement or post any security measure, our CCTV cameras are smashed and we are being sue for invasion for privacy; the privacy of burglaries, assaults, and harassment.
The privatisation of crime by locked down, locked out community is being overlooked even by the Courts.

Your comments will greatly be appreciated.
