        Hi everyone, I must tell you all that I'm Severely Disabled, Mentally and Physically...I'm pleased to get that off my mind, I suffer mainly from Severe Chronic Anxiety, I feel I have to tell people this, because I tend to go offline a lot. Anyway, I haven't had the Physical side of my Disability, since I had an accident some years ago...Right! Now I'll get down to why I came to this site in the first place.

        Q1:- On November 27th 2007, a guy was on the phone to me with regards to a Loan I had applied for with 'Debtbuster Loans'. He asked me if I wanted a PPI, and I replied, with a definite "NO Thanks", but I can't go any further with this part of the start of the Loan, because I had to go through the main Party, who were going to actually lend me the money, for Legal Reasons. I can explain why at a later date if needs be, because this was actually sorted between myself and Debtbusters who are a subsiduary of Central Trust, who actually settled with me, a compensation deal, and I signed a Legal note with Central Trust for Mis-selling me a PPI...Now this is the difficult part to explain...

        The main lender is Swift Advances plc., with whom I have no Financial relationship with, and they haven't had the decency to offer to send me any Financial Statements, as long as they are getting their money on regular basis, which is far too much, with what it was originally set out to be. I am actually paying out £430.00 a month, they have actually tried to Repossess my home, (which is currently on the market for sale) twice now, by taking me through the Courts. The way they do things is with extreme stealth. I have researched this PPI mis-selling on and off for some 2 years now, but my Disibility is holding me back, and lack of money. What Swift actually did was add the money I was paid out by Central Trust, and now I'm having to pay them back. This is itself, an illegallity. Please can anyone help me...Regards, Bluebird.:beagle:

          Q2:- I recently went down to the Halifax, to recoup my Bank Charges for the past six years, one of my Carers had to take me down, because very soon I will be confined to a wheelchair. I took all relevant paperwork with me, and yes, a letter has already been sent to there main office, by my local Community Law Centre, and it will probably still in one of the Post Bags waiting to be opened...Anyway, I limped and wobbled in, the young man who came to see me, (My anxiety at that moment in time was already high), I was tongue tied as he was getting very flustered as I was trying to get my Doctors letter out of my bag, that I have to give to anyone I talk to, to shed some light on my illness. He actually said to me "hope you've paid for your Statements", I couldn't help snapping back at him when he said that to me. Then he said, "If your going to be like that, you may as well go". I had to literally beg him to hear me out, but alas it fell on deaf ears. I wish to god I had never gone, but I'm in such severe financial hardship, I had to go to see if they had any compassion...alas not. I'm also Diabetic and need 3 basic meals a day, but I'm just living on some shopping my Mother gets for me, she cannot afford to feed me as she's a Pensioner. My motto is 'BE JUST & FEAR NOT'. Thinking of changing it after being humiliated in the Halifax, with one of the Female Staff looking in my direction and laughing at the same time, and an audience of Customers just standing there in the queue, with no offer of help. I've done everything by the book, as one would say. :tinysmile_cry_t: I used to be strong, now, I feel as though I'm losing it, I'm a bit of a recluse since that day.             Bluebird, it will be a pleasure to help you out.
            I am more knowledgeable on q2 so I hope you don't mind if I let others deal with part one. What progress has been made re the claim for bank charges and financial hardship? Have you sent in the prelim yet or are you awaiting your data/statements?

                Hi Bluebird, I'm so glad you came back on.

                I daren't say what I would like to about the treatment you received from Halifax. Sick making, how bloody dare they treat you that way.

                The Hardship claim is really best to keep in writing. We'll help you write a letter if you would like, if you can tell us exactly where you are up to. The community law centre have sent in the first letter asking for a refund ? Did this include details of your financial circumstances and health difficulties ?


                Swift advances - I will ask someone to take a look as this is quite complicated but I think I understand whats gone on, it may be best to deal with the issue of bank charges hardship first, get that claim running, then have a look at the rest.

                We'll help as much as we are able - if we are going to fast or you don't understand anything, please don't be worried about saying. No one will judge you on here.

                  Good Morning Amethyst,

                  I'm very anxious today, not been sleeping too well...have a BIG task ahead of me over the next few days. Have been going over my finances which I normally do, every week. And I have a small shortfall, which means I have to contact Swift Legal Services, and request, if I can, they take a little less than what I normally pay £430.00.

                  Problem being, I have never needed to actually contact them myself, it was all handled by the Community Law Service, just last year. "Oh, no, I've put my foot in it again", I did actually contact their Customer Services, I think it was just after my second payment to them, I'm still looking for the Contract, but cannot remember where I put it...which is very annoying.

                  Well, I rang up to complain about a letter I never received, only by chance I'd got a letter from the Bank stating they had to administer a charge £39.00 for not having enough funds to pay Swift Advances, actually this is when all my problems really started to spiral out of control. After reading through the small print on the contract, it stated that Swift would contact me by phone, after 14 or 16 days, in case the letter hadn't got through, to tell of a small increase in my payments to them. I rang them and a girl answered, I told her my problem, and asked them if anyone had made that phone call, she looked on her system, and replied "No, we don't have to because we sent a letter out" but I told her it's in the contract, and I've incurred a Bank Charge, "well there is nothing I can do about that she said".

                  Now I'm so nervous thinking about it. I've found out they have a Website. But the thing is, if I miss a payment, they'll Repossess my Flat...I was posting this reply regards a Halifax letter you could assist me with, sorry, my mind tends to wander, I'll post another reply to Bank Charges while I'm up to typing.

                    My most humble appologies for not getting back in touch With regards the Hardship letter, my life is not my own at the moment. :tinysmile_hmm_t2: Yes, please, could you help me with a letter, all I know is the Law Centre sent the letter regarding Refund of Bank Charges to the Halifax Head Office, which is probably still in a bag waiting to be opened. But I did tell them it had togo to The main Branch in Carlisle. My manager there has since left to look after his wife who has the same illness as me. Otherwise I would have got my Bank Charges back by now. Could this be part of the strategy taken by Banks, to change all Managers, in all branches, for someone hardfaced who wans to get on the second flight of stairs to the top.

                    What I can't understand is that anything relating to Refunds, is that you have to make an appointment with your Branch manager in Carlisle, by going through the Leeds Head Office. I do know of a few people, with good jobs and not disabled, have actually been in to the Branch in Carlisle, without an appointment, and got there refunds over the counter. Is it because I'm disabled that they think they can walk over me. when I was not disabled I could go anywhere and get anything just by talking on a face to face basis, now its, we are looking down on you. I'm getting tired and all I can say, is I'm starting to jumble my words and my mind is going blank every now and then.

                    As far as I kno the prelims have been done, but I will try and get in touch with the Law Centre, asap...

                      Need a few questions answering to sort out the hardship claim for the bank charges.

                      What is your income made up of ? (eg: Income Support/Incapacity etc)

                      Do you have any formal reposession action threats from Swift ? Has the £430 been set by the court to repay arrears ? Whats the position now?

                      Do you have any other debts? If so who with, how much are the payments and are there any arrears ?

                      Did the law centre calculate how much your bank charges came to? and did they do a financial statement (income/expenditure) with you?

                      Do you have the statements/transaction lists from the bank already ?
