  • Joint Freehold

Hi I jointly own the freehold of a building (2 purpose built flats) each has a lease in common. The woman downstairs moved in several years ago and has proved to be the neighbour from hell. Her latsest tricks include putting a lock on the gate to the backyard.(about 2 years ago) the land registry documents clearly state all the land back, front and sides are jointly own. She says it is "her prvate space". She has an extemely foul mouth and has yob male lodgers living there who try to intimidate both myself and my visitors.
In the last 7 months I have put 3 notes through her letterbox. 1 telling her a surveyor was coming in an effort to sort the issues out. She came to the gate asking if he wanted to come into the backyard he said yes. She locked the backgate and said "it was her private space" 2 swas to ask her to unlock the backgatte as the gasman was coming to install a new boiler and needed access to the flue. She would not allow the gasman access until he told her the Police had been called. 3 Was to tell her I waanted the lock removing from the gate as I wanted to put a shed in the backyard for my mobilty scooter. (She has 2 sheds in the backyard already. No permission was ever given for her to put these sheds up. What did she do she sent the Police to my home saying I was harrasing her by sending 3 notes in 7 months.
I want access to the backyard and I also want a bit of peace and quiet. Any suggestions?????

    Hi CASSIE1234

    Welcome to LB

    Have you contacted the Council?

Although, it's private residents, they do have to look after your 'welfare'.

It does sound like she's being totally 'unreasonable' about giving you access to the 'backyard'.

I'd say it's the best way to communicate.

If you are being 'harassed' by yobs, you are covered by the Prevention of Harassment Act 1997.

Hi I have contacted the Council despite being a disaabled old age mixed race peensioner they don't seem to want to know. The Police told me to get a security system which stopped her yob lodgers hammering on the door late night. But the Policce don't do anything either.

Have you got any insurance policies that cover legal expenses?
