  • Question about Rehabilitation of Offenders Act 1974

    Hi everyone,

    I have a question regarding the Rehabilitation of Offenders Act 1974 in the UK. I'm from Sweden, and in 2016, I was convicted of theft and received a fine of £200 along with a conditional sentence. Since then, I've maintained a clean record.

    My question is: According to the Rehabilitation of Offenders Act 1974, would this theft conviction be considered spent or unspent? I want to ensure I have a clear understanding before disclosing it. Any insights or advice would be greatly appreciated.

    I'm not sure what you mean by a "conditional sentence" as there are several different types of outcome that can be "conditional". However have a look at the list on this site. It would seem that your fine and sentence are likely to be long ago spent, assuming this is your only conviction and that you are in England or Wales.

    Bear in mind though that in some jobs an "enhanced disclosure" is required and you may have to disclose your spent conviction if applying for those jobs (different rules apply to when you don't have to disclose a conviction in these jobs). Teaching, working with children or vulnerable adults, jobs in healthcare and schools etc.
