    I was involved in a road rage attack where I was pushed to the ground sustaining a broken hip and 2 week hospital stay, my attacker once realising that my injuries were serious I was accused of racially abusing the gentleman which is completely false and so wasn't charged with any offence, My claim for criminal injuries was rejected because an independent witness had come forward and claimed I was the aggressor and was in my attackers face pictures taken at the scene show me prone on the floor along side of my drivers door, I have since found out that this was not a written statement but was apparently said to one of the police officers and no name or details were obtained.
    This is a shortened version of events and I have no evidence of the existence of this witness but can the tribunal use hearsay evidence against me. The police report to CIB stated that they had a statement from an independent witness.
