  • BCA legal advice

I registered for a BCA (British Car Association) Account back in September/October. When we got the account I had a big issue.

I was getting cars added onto my account which “I had purchased”.. These were not me and I kept calling BCA and changing my password.
Some of these cars were paid for and some were even collected. Long story they investigated and saw that they sent the same activation email to me and other people hence why this was showing on my account. Please note that these were cars less than 2k.

We purchased two cars for 1.2k and 1.5k in between all tha and now. Now last week we got a car worth 54k added onto the account. We reported this to BCA whom said theyll look into it and contact that day as it will be marked urgent. We got no contact and asked to speak to the lady whom worked on this matter last time.

Shes away on holiday. Long story we got told that its down to the branch whom said we either pay for it and relist it or we are liable for the difference.

This is impossible as we do not have money for either.

We then sent multiple emails. Today we got a call from the branch who said this “If you can prove this happened before we will remove the car” - I recorded the call. He stated he couldn't see any notes on the account.. We called back Customer Service whom said there a loads of notes and connected us back.

Long story after being on hold for 40 minutes they said yes we can see it happened before but as it was resolved and you changed password we can’t do anything and you are liable. We stated before we changed our password 100 times when we had about 24 cars added last time and still nothing happened. This was said apparently by a regional manager. Then they proceeded to lie saying we never said this and only when i mentioned again the convo was recorded they said, it is illegal to record and that we are liable and said they are hanging up.

I am not sure what to do. I can not afford a lot of money and do not want them coming after me.

Are you buying/selling on BCA as a private individual or as a motor trader (even if only in a small way)?

If you are buying/selling as a private individual what they said is not true. You are entitled to record your phone conversations with anybody. They are just BS'ing you to try and shut you up.

There may be restrictions on what you can do with the recording, and whether it could be used in legal proceedings, but that is a different matter.

All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.

I’m an individual on there. I have only bought two cars and they were for personal use. I was hoping to set up as a trader but after this I probably won’t. I would like to know what I can do. I don’t have remotely anything near to this and BCA are trying anything not to cancel this
