Hi, I had a finance agreement with Duncton No.1 Ltd to fund a car they sold to me (they used to sell used cars via their website), prior to them re-branding as Moneybarn No.1 Ltd. The car developed a serious fault, but was repaired under the manufacturers warranty (less than 3 years old), but I really struggled to keep up the repayments on the car and eventually it was returned to them. This was not the end of it however, a full 2 years later (of not hearing anything from them), I received a bill for around £4,400 which I could not pay! They then obtained a 'charging order' against my house (around 2009). When the house was sold in January this year, they then collected these monies. I have no record of my agreement with Duncton and my solicitors repaid the money to them. Do I have any legal redress with Moneybarn for the mis sold credit agreement? I appreciate that every post I have seen is for Moneybarn, but I dealt with them when they were 'Duncton', does this make any difference legally?

Hi, there is no typo on the dates (although they are approximate). The car was an 02 registered car and was less than 3 years old. It was repaired just inside its warranty so that takes us to 2005. I returned the car around 2006, then 2 years silence, by which time I had moved. Around 2 years later the documents arrived in the post like a bolt from the blue. It ran its course as I couldn't afford it and they got judgement. I'm sorry I cannot be more specific. Jason
