Due to the COL crisis my wife and I unfortunately fell behind with our debt repayments. 99% of creditors have been understanding and we have repayment plans in place but our Aqua credit card debt is being dealt with by Nolan's solicitors and I have never had the misfortune to have to deal with a company such as this in my life.
We first recieve contact re the debt so we filled out income and expenditure forms and sent them off, offering £20 p/m (an amount we offered all creditors to give them all something with a view to focusing on one at a time to clear them off). They wrote back saying our I&E showed a surplus of £700 free per month and they were rejecting the £20 offer and instead wanted £550 p/m.
I wrote back telling them this was completely unacceptable as their I&E didn't account for my other debtors etc and there wasn't £700 free (I also informed them that if I had £550 per month to make payments they wouldnt have been involved in the first place!)
I heard nothing back until a letter arrived saying we had defaulted on the agreed repayment schedule and had 7 days to clear the arrears. I was astonished as how can I repay arrears if we didnt have a repayment plan in place?
I wrote to them to explain this but before they could even receive it yet ANOTHER letter arrived threatening court action and sheriff officers. They are firing the letters out and escalating this whole situation at such a speed we cant draw breath and take stock. I also feel they are being incredibly underhanded and devious by doing the bare minimum required from them legally but still manipulating to escalate everything beyond what is needed.
Any help anyone can give would be appreciated as my wife suffers from anxiety and isn't able to cope with these totally unnecessary threats from a company who clearly dont care people are struggling.
