  • HMO unjust Council tax Liability order

    Hi all,

    I'm seeking guidance on a situation that I believe is unjust and in violation of my rental contract. In 2020, I resided in an HMO for 10 months, and the lease explicitly stated "all bills included, including council tax."

    The predicament I face:

    1) The council claims to have sent me four summons notifications between August 2022 and May 2023, but I received none. They initially charged me the full council tax without the 25% single person's discount. After sending a revised bill with the discount, they added a £90 fee for a liability order, of which I was unaware.

    2) The landlord offered to cover 50% of the council tax, citing potential business jeopardy if he pays the full amount. I find this offer unacceptable.

    Local legal debt advisors recommend negotiation, and if unsuccessful, pursuing a small claims process. I'm at an impasse and lack proper legal assistance. A solicitor quoted £600, but the disputed council tax is £1400 so it’s not worth it.

    I'm unsure about the next steps and would greatly appreciate any advice or insights.
