    I have a complaint regarding a Car dealer who I purchased a car off on 4th Aug 2023 over the next 2 days I noticed the car had some faults. The ABS Sensor was intermittently triggering on the dashboard & rough idling on the initial morning startup. I informed the dealer of these issues on 7th Aug 2023 & was told to wait for diagnosis & repair until the door lock for the car had arrived which was pre-arranged to be fixed when I purchased the car.

    This was a real pain as I could only drive the car locally due to the ABS sensors going off intermittently. During that time I also noticed there was an oil leak, Handbrake not working, rear heater not working & also leaking rear shock absorber. I made a list of these issue & managed to book the car in for diagnosis & repair on 24th Aug 2023, I was informed repairs would take 1-2 days. I waited patiently for the repair but was now informed on the 31st Aug 2023 that they were still waiting on parts due to Faulty fuse box. By this time I had lost patience & sent them 30 day Short rejection letter outlining all my issues.

    On the 6th Sept 2023 I received an email from the dealer letting me know the car had been fixed or if I wanted to reject the car there is a charge of £500. I decided to pickup the car 14th Sept 2023 & whilst driving the car another error message appeared on the dashboard telling me "Loss of power", car would not start until I pulled the key out & put the key back in. Following day 15th Sept 2023 I took the car back to dealer to diagnose & repair which he did. Next morning I started the car & I still had the rough idling on initial startup therefore I let the dealer know that there was still a problem with car, he told me to keep driving to see if problem goes away, problem did not go away I did some research & found that the symptoms of this particular engine sounded like an Injector failure as it only occurs first this in the morning.

    I informed the dealer & left the car with dealer for him to his fault finding I also sent him a letter Letter before Court Claim & he needs to reply within 14 days before court actions. I have spoken to him about a refund as I am not willing to accept another repair after 1st attempt failed. He has said that he will not refund all the money & charge me for the fixes he has done to the car.

    I've done a calculation of the days & I am just within the 30 days as the car was with the dealer for rest of the days & the 30 day rule of delay applies when car is with the dealer.

    I wanted to find out what my plan of action can be next as it looks like the Dealer is not willing to provide a suitable refund & he also mentioned that I can take him to court, he does not care.

      How much did you pay for the car and how did you pay?
      How old is the car and what is its mileage?
      How was the car described in the advert and what did the dealer say when you inspected the car and during the test drive?
      Is all the paperwork for the car ok?

        Points 9.1 to 9.18 cover your rights (and the dealer's obligations) under CRA 2015 Part 1 Sections 20 and 22.
        You rejected the car within 30 days, so you have the short term right to rejection.
        The dealer should refund your payment for the car in full without any deduction.
        If the dealer does not reply to your LBA within 14 days or you are unhappy with his response you should start a court claim
        If you decide to make a court claim you could come back to LegalBeagles for advice.

          The car is 2010 so 13 years old, 55k miles, so low miles for year & only 2 owners. Part service history. I paid £7800, Dealer did not reduce a penny of the advertised price. All the paper work was in place but had part service history only, all MOT history was up to date. When I test drove the car I found no issues. Rear passenger door was not opening therefore the Dealer agreed to replace the lock & said would take 10 days to get the part.

            Sorry forgot to mention I paid half the balance with cash & the rest as a bank transfer

              As your claim would be under £10k it should be allocated to the small claims court where paying the other parties legal fees are limited.
