  • Owning property with Ex Partner.

    I bought a property with my ex partner, we broke up in February. At that time he refused to leave, refused to sell and refused to buy me out. So I moved in with my parents and have been living here since.

    He also said that if I didn’t pay half the mortgage that it would show up on my credit score etc so I have been paying him £220 and our mortgage is £325 (this was for ground rent on the flat too I believe).

    I am not really in contact with him because it is hostile. However, my mum and dad are having to downsize due to the mortgage payments and I need to move into a property of my own. This just isn’t affordable if I continue paying the mortgage and so I’m at a real risk of being homeless.

    The ideal solution would be that the flat is sold and I can move on with my life but he is refusing this, is there going to be negative repercussions if I stop paying the mortgage while not living there? I’m at a massive loss as to what to do to be honest. Any help you have would be great.

    You can apply to the Court for an order under the Trusts of Land and Appointment of Trustees Act 1996 requring the property to be sold and determining how the net proceeds are to be distributed after payment of mortgage, sale costs etc.

    Consult a solicitor.
